44. On the subject of the proposed agreement between the Government of the Russian Federation and the Pension Board on former participants in the Fund from the former Union of Soviet Socialist Republics, he said that the issue had been a matter of concern for the Government of his country ever since the General Assembly had concurred with the proposed agreement in 1996.
٤٤ - أردف يقول إنه فيما يتعلق بموضوع الاتفاق المقترح بين حكومة الاتحاد الروسي ومجلس الصندوق بشأن المشتركين السابقين في الصندوق من اتحاد الجمهوريات الاشتراكية السوفياتية السابق، فإن المسألة تشكﱢل شاغلا بالنسبة لحكومة بلاده حيث أن الجمعية العامة وافقت على الاتفاق المقترح في عام ١٩٩٦.

Throughout the negotiations in Moscow, the Russian delegation had maintained that it would be neither appropriate nor legally justifiable to include in the proposed agreement between the Board and the Government of the Russian Federation any reference to former participants other than those who were citizens of the Russian Federation itself, so as not to interfere with the freedom of action of other Governments.
٦٥ - واستطرد يقول إن الوفد الروسي، أكد طوال المناقشات التي جرت في موسكو، أنه من غير الملائم ولا من المبرر قانونا، إدخال أية إشارة في الاتفاق المقترح بين المجلس وحكومة الاتحاد الروسي الى المشتركين السابقين غير مواطني الاتحاد الروسي ذاته، حتى لا يكون هناك تدخل في حرية عمل الحكومات اﻷخرى.

The representative of Ukraine had also asked whether the letter and spirit of the proposed agreement between the Government of the Russian Federation and the Pension Board were in keeping with article 34 of the Vienna Convention on the Law of Treaties, under which a treaty did not create either obligations or rights for a third State without its consent.
٦٨ - كما تساءل ممثل أوكرانيا عما إذا كان نص وروح الاتفاق المقترح بين حكومة الاتحاد الروسي ومجلس المعاشات التقاعدية يتمشيان مع المادة ٣٤ من اتفاقية فيينا لقانون المعاهدات، والتي بموجبها لا تشكل معاهدة ما التزامات أو حقوقا بالنسبة لدولة ثالثة بدون موافقتها.

Regarding the proposed agreement between the Government of the Russian Federation and the Pension Board, the chronology of developments leading to the adoption of a step-by-step approach, rather than awaiting a possible comprehensive agreement, had been presented in the Board's report and in statements to the Committee.
٣٣ - وتطرق الى الاتفاق المقترح بين حكومة الاتحاد الروسي وصندوق المعاشات التقاعدية، فقال إن التسلسل الزمني للتطورات التي أدت الى اعتماد نهج التدرج خطوة خطوة، بدلا من انتظار التوصل الى اتفاق شامل محتمل، معروض في تقرير المجلس وفي البيانات المقدمة الى اللجنة.

Accordingly, it was clear to his Government that the proposed agreement between the Government of the Russian Federation and the Pension Board was incompatible with article 34 of the Vienna Convention on the Law of Treaties, which provided that no treaty should create either obligations or rights for a third State without its consent.

1. Concurs with the proposed agreement between the Government of the Russian Federation and the United Nations Joint Staff Pension Board, pursuant to article 13 of the Fund's Regulations, as set out in annex VI to the report of the Board; a/
