" 1. This Convention shall apply to investor-State arbitration conducted on the basis of a treaty providing for the protection of investments or investors between Contracting Parties to this Convention.

وإذ تلاحظ ضخامة عدد المعاهدات النافذة بالفعل التي تنص على حماية الاستثمارات أو المستثمرين، وما لتشجيع تطبيق قواعد الأونسيترال بشأن الشفافية على التحكيم الذي يُجرى بمقتضى تلك المعاهدات الاستثمارية المبرمة بالفعل من أهمية عملية،

" Recognizing further that some parties to investment treaties have adopted high transparency standards in certain treaties providing for the protection of investments or investors,
" وإذ تُسلِّم كذلك بأنَّ بعض الأطراف في معاهدات الاستثمار اعتمدت معايير شفافية رفيعة المستوى في بعض المعاهدات التي تنص على حماية الاستثمارات أو المستثمرين،

" 1. This Convention is open until [date] for signature by any Party to a treaty providing for the protection of investments or investors.
" 1- يُفتَح باب التوقيع على هذه الاتفاقية حتى [التاريخ] أمام أيِّ طرف في معاهدة تنص على حماية الاستثمارات أو المستثمرين.

" Further recognizing that some States have adopted high transparency standards in certain treaties providing for the protection of investments or investors ( " investment treaty " ),
" وإذ تُسلِّم كذلك بأنَّ بعض الدول قد اعتمدت معايير شفافية رفيعة المستوى في بعض المعاهدات التي تنص على حماية الاستثمارات أو المستثمرين ( " معاهدة الاستثمار " )،

After discussion, it was agreed that the words " treaty providing for the protection of investments or investors " would be replaced by the word " treaty " and, as an alternative, " investment treaty " , both in square brackets, for consideration by the Working Group at its second reading of the transparency convention.
71- وبعد المناقشة، اتُّفق على الاستعاضة عن عبارة " معاهدة تنص على حماية الاستثمارات أو المستثمرين " بكلمة " معاهدة " ، وكمُقترح بديل بعبارة " معاهدة استثمار " ، على أن يرد الخياران بين معقوفتين لكي ينظر فيهما الفريق العامل في قراءته الثانية لاتفاقية الشفافية.

4. For investor-State arbitration initiated pursuant to a treaty providing for the protection of investments or investors, these Rules include the UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration ( " Rules on Transparency " ), subject to article 1 of the Rules on Transparency.
4- في التحكيم بين المستثمرين والدول الذي يُستهل بمقتضى معاهدة تنص على حماية الاستثمارات أو المستثمرين، تشمل هذه القواعد قواعد الأونسيترال بشأن الشفافية في التحكيم التعاهدي بين المستثمرين والدول ( " قواعد الشفافية " )، رهناً بالمادة 1 من قواعد الشفافية.

Footnotes It was suggested to amend the footnotes to article 1, paragraph (1), in order to ensure that the term " treaty providing for the protection of investments or investors " could also be applied to territories that might be treaty parties but that would not fall under the definition as currently drafted.
35- اقتُرح تعديل حاشيتي الفقرة (1) من المادة 1 ضماناً لأن تكون عبارة " معاهدة تنص على حماية الاستثمارات أو المستثمرين " قابلة للانطباق أيضاً على الأقاليم التي قد تكون أطرافاً في المعاهدة ولكنها لا تندرج ضمن نطاق التعريف بصيغته الحالية.

Another suggestion was made to align the definition of " treaty providing for the protection of investments or investors " in the first footnote more closely with the definition of a " treaty " in the Vienna Convention on the Law of Treaties, with necessary adaptation for the purpose of the rules on transparency.
36- وقُدِّم اقتراح آخر بجعل تعريف " المعاهدة التي تنص على حماية الاستثمارات أو المستثمرين " ، الوارد في الحاشية الأولى، أكثر اتساقاً مع تعريف " المعاهدة " في اتفاقية فيينا لقانون المعاهدات،() مع تكييفه على النحو اللازم لأغراض قواعد الشفافية.

" (1) The Rules on Transparency shall apply to investor-State arbitrations initiated under the UNCITRAL Arbitration Rules pursuant to a treaty providing for the protection of investments or investors (`treaty') concluded after [date of coming into effect of the Rules on Transparency], unless the Parties to the treaty have agreed otherwise.
" (1) تنطبق قواعد الشفافية على عمليات التحكيم بين المستثمرين والدول التي تُستهل بمقتضى قواعد الأونسيترال للتحكيم عملاً بمعاهدة تنص على حماية الاستثمارات أو المستثمرين ( " المعاهدة " ) مُبرمة بعد [تاريخ بدء نفاذ قواعد الشفافية]، ما لم يتفق طرفا المعاهدة على خلاف ذلك.

" (1) The Rules on Transparency shall apply to investor-State arbitration initiated under the UNCITRAL Arbitration Rules pursuant to a treaty providing for the protection of investments or investors* ( " treaty " ) concluded after (date of coming into effect of the Rules on Transparency), unless the Parties to the treaty** have agreed otherwise.
" (1) تنطبق قواعد الشفافية على التحكيم بين المستثمرين والدول الذي يُستهل بمقتضى قواعد الأونسيترال للتحكيم عملاً بمعاهدة تنص على حماية الاستثمارات أو المستثمرين* ( " المعاهدة " ) مبرَمة بعد (تاريخ بدء نفاذ قواعد الشفافية)، ما لم تتفق الأطراف في المعاهدة** على خلاف ذلك.

The proposed new paragraph (4) to article 1 of the UNCITRAL Arbitration Rules uses the phrase, " treaty providing for the protection of investments or investors " , which phrase is defined in a footnote to draft article 1 of the rules on transparency.
36- تستعمل الفقرة (4) المقترحة الجديدة في المادة 1 من قواعد الأونسيترال للتحكيم عبارة " معاهدة تنص على حماية الاستثمارات أو المستثمرين " وهي العبارة المعرَّفة في حاشية مشروع المادة 1 من قواعد الشفافية.

The Commission may wish to note that the definition of a " treaty providing for the protection of investments or investors " in article 1(2) reflects the definition of article 1 of the draft rules on transparency (see document A/CN.9/783, para. 4).
7- ولعلّ اللجنة تودّ ملاحظة أنَّ تعريف " معاهدة تنص على حماية الاستثمارات أو المستثمرين " الوارد في المادة (1) (2) يجسّد التعريف الوارد في المادة 1 من مشروع قواعد الشفافية (انظر الوثيقة A/CN.9/783، الفقرة 4).

Further to the deliberations on paragraph (1) of the revised draft proposal, that paragraph would read as follows: " This Convention applies to investor-State arbitration conducted on the basis of a treaty providing for the protection of investments or investors. "
66- بعد المداولات التي دارت بشأن الفقرة (1) من مشروع المُقترح المنقَّح، أصبح نص هذه الفقرة كما يلي: " تنطبق هذه الاتفاقية على التحكيم بين المستثمرين والدول الذي يجرى استناداً إلى معاهدة تنص على حماية الاستثمارات أو المستثمرين. "

" Each Contracting Party to this Convention agrees to apply the UNCITRAL Rules on Transparency to investor-State arbitration conducted pursuant to a treaty providing for the protection of investments or investors to which it is a Party.
