139. With a view to clarifying the notion of " provisional or protective measures " , it was suggested that a paragraph 2 should be inserted in draft article 74, containing a definition of provisional or protective measures, with the following text:

140. While support was expressed for the insertion of paragraph 2 in draft article 74, the view was also expressed that any attempt to define " provisional or protective measures " might entail numerous problems while not contributing to the clarity of the draft instrument.
140- ولئن حظي إدراج الفقرة 2 في مشروع المادة 74 بالتأييد، فقد رئي من ناحية أخرى أن أي محاولة لتعريف " التدابير المؤقتة أو الوقائية " قد تترتب عليها مشاكل عديدة دون أن تسهم في توضيح مشروع الصك.

In reference to draft article 72, subparagraph (a), in particular with respect to fulfilling " the requirements of this chapter " , it was observed that the court granting the provisional or protective measures would make a determination regarding its jurisdiction to determine a case upon its merits in light of the provisions set out in chapter 14.
219- بالإشارة إلى الفقرة الفرعية (أ) من مشروع المادة 72، خصوصا فيما يتعلق باستيفاء " مقتضيات هذا الفصل " ، ذكر أن المحكمة التي تصدر التدابير المؤقتة أو الوقائية سوف تبت بشأن ما إذا كانت لها ولاية الفصل في الدعوى بناء على مقوماتها على ضوء الأحكام الواردة في الفصل 14.

47. The Working Group was reminded that it had considered draft provisions on arrest and provisional or protective measures during its fourteenth (see A/CN.9/572, paras. 137 to 139) and fifteenth sessions (see A/CN.9/576, paras. 129 to 142).

Article 72 gives the impression that one has to enter into this Convention in order to protect the owner of goods and the holder of other rights because the text clearly removes powers from the courts of the state taking the provisional or protective measures.
62- توحي هذه المادة بوجوب الدخول في هذه الاتفاقية لحماية أصحاب البضائع وأصحاب الحقوق الأخرى، فمن الواضح أنّ نصها يجرّد محاكم الدولة من صلاحياتها في اتخاذ التدابير المؤقتة والوقائية.
