The proceedings are conducted ex officio as soon the court receives a report from a psychiatric facility or learns otherwise of a person confined to a psychiatric facility without his consent.

107- ويجب أن يخضع الشخص المودع في مرفق الطب النفسي لتدابير العلاج اللازمة.

A decision on placement in and release from a psychiatric facility may be appealed by the psychiatric facility in which a mentally person is placed, the mentally ill person, guardian or temporary representative or the guardianship authority within three months from the day on which they received the decision.
110- ويجوز لمرفق الطب النفسي الذي يودع فيه الشخص المختل عقلياً، أو الشخص المختل عقلياً نفسه، أو الوصي عليه أو الممثل المؤقت له، أو السلطة الوصية عليه، الطعن ضد قرار إيداعه في مرفق الطب النفسي والإفراج عنه، في غضون ثلاثة أشهر من يوم تلقي القرار.

If a psychiatric facility finds that a mentally ill person should remain in treatment after the expiry of the period determined by the court, it must submit a proposal to this effect within seven days before the expiry of the forced placement ordered by the court.
108- وإذا وجد مرفق الطب النفسي أن الشخص المختل عقلياً يجب أن يستمر في العلاج بعد انقضاء المدة التي حددتها المحكمة، فإنه يجب أن يتقدم باقتراح بذلك خلال سبعة أيام قبل انتهاء الإيداع القسري الذي أمرت به المحكمة.

The court may decide, even before the expiry of the confinement period provided that the psychiatric facility submits a proposal to this effect, to release a mentally ill person from a psychiatric facility if it is satisfied that his health status has improved to such an extent that his further confinement is not justified.
109- ويجوز للمحكمة أن تقرر، حتى قبل انتهاء فترة الإيداع شريطة أن يتقدم مرفق الطب النفسي باقتراح بذلك، الإفراج عن شخص مختل عقلياً من مرفق الطب النفسي إذا اطمأنت إلى أن حالته الصحية قد تحسنت إلى الحد الذي لم يعد هناك ما يبرر استمرار إيداعه.

A report of the psychiatric facility must include a decision of a psychiatrist on forced confinement accompanied with appropriate documentation, in accordance with the Law on Protection and Exercise of Rights of Mentally Ill Persons (Official Gazette of the Republic of Montenegro 32/05).
