Article 304 defines the concept of terrorist acts as follows: " Terrorist acts " means all acts intended to create a state of fear which are committed by means such as explosives, inflammable materials, poisonous or burning products or epidemic or microbial agents likely to cause public danger.
أما المادة 304 فقد حددت ماهية الأعمال الإرهابية حيث نصت على ما يلي: يُقصد بالأعمال الإرهابية جميع الأفعال التي ترمي إلى إيجاد حالة ذعر وترتكب بوسائل كالأدوات المتفجرة والمواد الملتهبة والمنتجات السامة أو المحرقة والعوامل الوبائية أو الجرثومية التي من شأنها أن تحدث خطرا عاما.

It submits that the court correctly qualified their acts, and imposed the proper sentences by taking into account the " public danger " of their crimes.
وتقول إن المحكمة كانت محقة في تجريم أفعالهما ولم تفرض حكميها الصائبين إلا بعد أن أخذت في اعتبارها " الخطر العام " لجرائمهما.

In essence, as we shall see below, this interpretation comes closest to the concept of “public emergency” employed in articles 4 of the International Covenant on Civil and Political Rights and 15 of the European Convention on Human Rights respectively and of “public danger” employed in article 27 of the American Convention on Human Rights, which constitutes a sine qua non or prerequisite for a state of emergency to be declared.

46. In addition, article 27 of the Convention authorizes the suspension of guarantees " in time of war, public danger or other emergency that threatens the independence or security of a State Party " .

This condition is not met where the goal of the act financed is to create a public danger liable to injure or place in jeopardy an indeterminate number of persons not belonging to the non-law-governed regime responsible for the human rights violations referred to in paragraph (1).
ولا يكون هذا الشرط مستوفى على الخصوص حينما يستهدف العمل الممول إشاعة خطر عام من شأنه أن يصيب أو يعرض للخطر عددا غير محدد من الناس الذين ليسوا أطرافا في النظام غير الخاضع للقانون المسؤول عن انتهاكات حقوق الإنسان المشار إليها في رقم 1.

1.2 Article 304 of the Syrian Penal Code states that terrorist acts means all acts that are intended to create a state of fear and are committed by means such as explosives, military weapons, inflammatory materials, toxic or incendiary products or epidemic or microbial agents likely to cause public danger.
1-2 لقد أوضح قانون العقوبات في الجمهورية العربية السورية في المادة 304 بأنه يقصد بالأعمال الإرهابية جميع الأفعال التي ترمي إلى إيجاد حالة ذعر وترتكب بوسائل كالأدوات المتفجرة والأسلحة الحربية والمواد الملتهبة والمنتجات السامة أو المحرقة والعوامل الوبائية أو الجرثومية التي من شأنها أن تحدث خطرا عاما.

Pre-eminent among those provisions is article 314 of the Lebanese Criminal Code, according to which " [t]errorist conduct means all conduct aimed at creating a state of panic and committed by such means as explosive devices, inflammable materials, toxic or corrosive products and infectious or microbial agents likely to create a public danger " .
وتبرز بين هذه الأحكام المادة 314 من قانون العقوبات اللبناني التي تنص على أنه " يُعنى بالأعمال الإرهابية جميع الأفعال التي ترمي إلى إيجاد حالة ذعر وترتكب بوسائل كالأدوات المتفجرة والمواد الملتهبة والمنتجات السامة أو المحرقة والعوامل الوبائية أو المكروبية التي من شأنها أن تحدث خطرا عاما " .

It ensures that criminal responsibility is not incurred by persons who have committed criminal acts which do not constitute a public danger and who have provided full compensation for the material and moral damage caused to the victims.
وهي تضمن عدم تحميل المسؤولية الجنائية للأشخاص الذين يرتكبون أعمالاً إجرامية لا تشكل خطراً عاماً والذين يدفعون تعويضاً كاملاً عن الأضرار المادية والمعنوية التي يتسبَّبون فيها لضحايا أفعالهم.
