1. " Recharacterization " of an interpretative declaration means a unilateral statement made by a State or an international organization in reaction to an interpretative declaration in respect of a treaty formulated by another State or another international organization, whereby the former State or organization purports to treat the declaration as a reservation.
1 - تعني " إعادة تكييف " إعلان تفسيري بيانا انفراديا تصدره دولة أو منظمة دولية كرد فعل على إعلان تفسيري متعلق بمعاهدة صاغته دولة أخرى أو منظمة دولية أخرى، وترمي به الدولة أو المنظمة مصدرة البيان إلى معاملة الإعلان بوصفه تحفظا.

3.14 Even though the reservation purports to exclude all communications relating to the sentence of death forwarded after 26 August 1998, the author submits that the reservation significantly impairs the competence of the Committee under the Optional Protocol to hear communications as it purports to exclude from consideration a broad range of cases, including many which would contain allegations of violations of nonderogable rights.

A unilateral statement formulated by a State or an international organization after signature but prior to entry into force of a bilateral treaty, by which that State or that organization purports to obtain from the other party a modification of the provisions of the treaty in respect of which it is subordinating the expression of its final consent to be bound, does not constitute a reservation, however phrased or named.
اﻹعلان الانفرادي الذي تصدره دولة أو منظمة دولية بعد التوقيع على معاهدة ثنائية وقبل نفاذها، وتهدف تلك الدولة أو المنظمة من ورائه حمل الطرف الثاني على تغيير أحكام المعاهدة، وتخضع له اﻹعراب عن موافقتها النهائية على التقيد بالمعاهدة لا يشكل تحفظا أيا كانت صيغته أو تسميته.

" Interpretative declaration " means a unilateral statement, however phrased or named, made by a State or an international organization, whereby that State or that organization purports to specify or clarify the meaning or scope of a treaty or of certain of its provisions.
يعني " الإعلان التفسيري " إعلانا انفراديا، أيا كانت صيغته أو تسميته، تصدره دولة أو منظمة دولية وتهدف به تلك الدولة أو المنظمة إلى تحديد أو إيضاح معنى أو نطاق المعاهدة أو بعض أحكامها.

A reservation by which a State or an international organization purports to exclude or to modify the application of a provision of a treaty in order to preserve the integrity of its domestic law may be formulated only if it is not incompatible with the object and purpose of the treaty. "
لا يجوز إبداء تحفظ ترمي به دولة أو منظمة دولية إلى استبعاد أو تعديل تطبيق حكم في معاهدة صونا لسلامة قانونها الداخلي إلا إذا لم يكن منافيا لغرض المعاهدة ومقصدها.
