The Secretariat was requested to reconsider the paragraph in the light of the distinct issues it addressed, such as assessment of qualifications of suppliers or contractors and evaluation of tenders.

The 1994 reference to " reputation " , on the other hand, has been deleted to eliminate subjectivity in the process of ascertainment by the procuring entity of the qualifications of suppliers or contractors.
ومن ناحية أخرى، حُذفت الإشارة إلى " السمعة " الموجودة في نصّ عام 1994 لإزالة الاعتبارات الذاتية في عملية تأكُّد الجهة المشترية من مؤهّلات المورِّدين أو المقاولين.

11. Paragraph (4) requires all criteria and requirements as regards assessment of qualifications of suppliers or contractors to be set out in any pre-qualification or preselection document and in the solicitation documents.
11- وتشترط الفقرة (4) أن تُبيَّن جميع المعايير والاشتراطات فيما يخصّ تقييم مؤهّلات المورِّدين أو المقاولين في أيِّ وثيقة من وثائق التأهيل الأولي أو الاختيار الأولي وفي وثائق الالتماس.

Since the general rule is that qualifications of suppliers or contractors may be ascertained by the procuring entity at any stage of the procurement proceedings, article 9(1) the 2011 Model Law avoids linking ascertainment of qualifications to any particular stage of the proceedings.
وبما أن القاعدة العامة هي إمكانية تأكُّد الجهة المشترية من مؤهّلات المورِّدين أو المقاولين في أيِّ مرحلة من إجراءات الاشتراء، فإنَّ المادة 9(1) من القانون النموذجي لعام 2011 تتفادى ربط التأكد من المؤهلات بأيِّ مرحلة بعينها من الإجراءات.

The Commission agreed that the provision should read as follows: " A summary of the criteria and procedures to be used for ascertaining the qualifications of suppliers or contractors, and of any documentary evidence or other information that must be submitted by suppliers or contractors to demonstrate their qualifications, in conformity with article 9 of this Law. "
106- واتَّفقت اللجنةُ على أن يكون نصُّ أحكام هذه الفقرة كالتالي: " ملخصاً للمعايير والإجراءات التي ستُستخدَم للتأكّد من مؤهّلات المورِّدين أو المقاولين، ولأيِّ أدلة مستندية أو معلومات أخرى يجب على المورِّدين أو المقاولين أن يقدِّموها لإثبات مؤهّلاتهم، بما يتوافق مع المادة 9 من هذا القانون. "

In this regard, it was noted that article 6 of the Model Law provided that the qualifications of suppliers were to be assessed on the basis of (inter alia) their professional, managerial and technical qualifications and competence, their resources and solvency, and that their directors were not subject to criminal investigation or prosecution.
ولوحظ في هذا الصدد أن المادة 6 من القانون النموذجي تنص على تقييم مؤهلات المورّدين بناء على معايير منها مؤهلاتهم وكفاءتهم المهنية والإدارية والتقنية ومواردهم وملاءتهم المالية، وعدم خضوع مديريهم لأي تحقيقات جنائية أو ملاحقة قضائية.
