Article 73 of the Vienna Convention expressly states that " The provisions of the present Convention shall not prejudge any question that may arise in regard to a treaty from a succession of States or from the international responsibility of a State or from the outbreak of hostilities between States " .
وأكدت في المادة 73 بكل وضوح أنه ' ' ليس في أحكام هذه الاتفاقية أي حكم مسبق في أية مسألة قد تنجم، بصدد معاهدة، عن خلافة الدول أو عن المسؤولية الدولية لدولة ما أو عن نشوب الأعمال العدائية بين الدول``.

As will be recalled, article 73 provides simply that " the provisions of the present Convention shall not prejudge any question that may arise in regard to a treaty ... from the outbreak of hostilities between States " . (emphasis added)

2. Article 73 of the Vienna Convention on the Law of Treaties is clear that it " shall not prejudge any question that may arise in regard to a treaty from ... the outbreak of hostilities between States. "

In fact, article 73 of that Convention contains a safeguard clause stipulating that " the provisions of the present Convention shall not prejudge any question that may arise in regard to a treaty from a succession of States [...] " .

The article in question specifies that the provisions of the Vienna Convention " shall not prejudge any question that may arise in regard to a treaty from ... the outbreak of hostilities between States " .
ويرد في المادة المشار إليها أنه " ليس في أحكام [قواعد اتفاقية فيينا] أي حكم مسبق في أية مسألة قد تنجم ... عن نشوب الأعمال العدائية بين الدول " .

In this context, one question that may need to be addressed is whether the term should include interests in business ventures that in some States might not be viewed as traditional securities (such as partnership interests and joint venture interests).
وفي هذا السياق ثمة مسألة قد يلزم تناولها؛ ألا وهي مدى وجوب أن يتضمن هذا المصطلح المصالح المتعلقة بالمشاريع التجارية التي قد لا يُنظر إليها في بعض الدول على أنها أوراق مالية تقليدية (كالمصالح الشراكية مثلاً والمصالح المتعلقة بالمشاريع المشتركة).

It is true that article 73 of the Vienna Convention also provides that its provisions " shall not prejudge any question that may arise in regard to a treaty ... from the international responsibility of a State " ; moreover, article 70 (1) (b) addresses situations of the " execution " or performance of a treaty rather than its nonperformance.
