25. Concerning the implementation of an expulsion decision, which was the subject of draft article D1 (Return to the receiving State of the alien being expelled), some had welcomed the approach of encouraging the voluntary departure of an alien being expelled insofar as measures to that end did not lead to undue pressure on the alien.

(b) If the matter is not adjusted to the satisfaction of both States Parties concerned within six months after the receipt by the receiving State of the initial communication, either State shall have the right to refer the matter to the Committee, by notice given to the Committee and to the other State;
)ب( إذا لم تتم تسوية المسألة بما يرضي كلا الطرفين المعنيين في غضون ستة أشهر بعد تلقي الدولة المتلقية البلاغ اﻷولي، يحق لكلا الطرفين إحالة المسألة إلى اللجنة، بموجب إخطار مقدم إلى اللجنة وإلى الدولة اﻷخرى؛

(a) Consideration by the receiving State of humanitarian and compassionate factors in the determination of the victim’s status in that State;

These means are, by their nature, entirely efficacious, for unless the sending State recalls the member of the mission objected to forthwith, the prospect of the almost immediate loss of his privileges and immunities, because of the withdrawal by the receiving State of his recognition as a member of the mission, will in practice compel that person, in his own interest, to depart at once.
وهذه الوسائل فعالة تماماً بطبعها، لأنه ما لم تستدع الدولة الموفدة عضو البعثة المعترض عليه، فإن احتمال فقدانه لامتيازاته وحصاناته، بسحب الدولة المعتمد لديها لاعترافها به عضواً في البعثة، سيجبر ذلك الشخص عملياً، على المغادرة النهائية، حفاظاً على مصلحته.

234. Some members supported draft article D1 on the return to the receiving State of the alien being expelled.

However, the question that warrants the greatest attention, since this is the stage of expulsion at which violence against the persons concerned generally occurs, is that of a general draft article regarding the conditions of return to the receiving State of expelled persons, containing a reference to the relevant international instruments, as proposed below:

Insofar as coercive measures might be necessary in cases where the person being expelled refused to abide by the expulsion decision, paragraph 2 of the draft article made appropriate provision for the orderly transportation to the receiving State of such persons.

Draft article D1 (Return to the receiving State of the alien being expelled) met that criterion; paragraph 1 established the possibility of the voluntary departure of an alien being expelled, while paragraph 2 dealt with the forcible implementation of an expulsion decision.
ورأت أن مشروع المادة دال 1 (إعادة الأجنبي موضوع الطرد إلى دولة الوجهة) يستوفي هذا المعيار؛ فالفقرة 1 تقر باحتمال المغادر الطوعية للأجنبي محل الطرد، بينما تتناول الفقرة 2 التنفيذ القسري لقرار الطرد.

17. With respect to draft article D1 (Return to the receiving State of the alien being expelled), her delegation supported the inclusion of a provision on the voluntary return or departure of an alien being expelled in that it would increase respect for human dignity and was simpler to administer.

33. Mr. Leonidchenko (Russian Federation), referring to the draft articles on the expulsion of aliens, said that an additional guarantee of respect for the rights of the person being expelled was offered by paragraph 1 of draft article D1 (Return to the receiving State of the alien being expelled), which provided that the State should encourage voluntary compliance with the expulsion decision.
33 - السيد ليونيدشنكو (الاتحاد الروسي): بدأ بيانه مشيرا إلى مشاريع المواد المتعلقة بطرد الأجانب وقال إن الفقرة 1 من مشروع المادة دال 1 (إعادة الأجنبي موضوع الطرد إلى دولة الوجهة) تقدم ضمانة إضافية لاحترام حقوق الشخص موضوع الطرد، حيث تنص على أن تشجِّع الدولة الامتثال طواعية لقرار الطرد.

56. His delegation supported the principle of encouraging voluntary compliance with expulsion decisions, as articulated in paragraph 1 of draft article D1(Return to the receiving State of the alien being expelled), although not in cases where the person concerned posed a threat to public order or security.
56 - وأعرب عن التأييد الذي يبديه وفده لمبدأ التشجيع على الامتثال الطوعي لقرارات الطرد، على النحو المنصوص عليه في الفقرة 1 من المادة دال 1 (إعادة الأجنبي موضوع الطرد على دولة الوجهة)، باستثناء الحالات التي يشكل فيها الشخص تهديدا للنظام العام أو الأمن العام.

62. Concerning the draft articles on the expulsion of aliens, draft article D1 (Return to the receiving State of the alien being expelled) should specify, in order to eliminate the potential for negative interpretation of its provisions, that the expelling State must adopt measures to promote the voluntary return of the alien being expelled.
62 - وانتقل إلى مشاريع المواد المتصلة بطرد الأجانب، فقال إن مشروع المادة دال 1 (إعادة الأجنبي موضوع الطرد إلى دولة الوجهة) يجب أن يوضح التزام الدولة الطاردة باتخاذ التدابير اللازمة لتشجيع العودة الطوعية للأجنبي المطرود، وذلك لإزالة احتمال تفسير أحكام مشروع المادة تفسيرا سلبيا.

(b) If the matter is not settled to the satisfaction of both States Parties concerned within six months after the receipt by the receiving State of the initial communication, either State shall have the right to refer the matter to the Committee, by notice given to the Committee and to the other State;
