If certain conditions were met, recorded testimony could be used during the trial phase, especially in cases involving sexual crimes, maltreatment or crimes against personal freedom.
وإذا استوفيت شروط معينة، يجوز استخدام الشهادة المسجلة خلال مرحلة المحاكمة، وبخاصة في الحالات التي تنطوي على جرائم جنسية أو إساءة معاملة أو جرائم ضد الحرية الشخصية.

(a) If the witness who gave the previously recorded testimony is not present before the Trial Chamber, both the Prosecutor and the defence had the opportunity to examine the witness during the recording; or
(أ) أن يكون كلا المدعي العام والدفاع قد أتيحت له فرصة استجواب الشاهد خلال تسجيل الشهادة، في حالة عدم مثول الشاهد الذي قدم الشهادة المسجلة سلفا أمام الدائرة الابتدائية؛ أو

(ii) If the witness who gave the previously recorded testimony is present before the Trial Chamber, he or she does not object to the submission of the previously recorded testimony, and the Prosecutor, the defence, the victims or their legal representatives in accordance with rules X to XX, and the Chamber, have the opportunity to examine the witness during the proceedings.

At its twelfth session, the Assembly of States Parties adopted amendments to rule 68 (Prior recorded testimony) and rule 100 (Place of proceedings), and adopted the following new rules: rule 134 bis (Presence through the use of video technology), rule 134 ter (Excusal from presence at trial) and rule 134 quater (Excusal from presence at trial due to extraordinary public duties).
