With regard to international liability for injurious consequences arising out of acts not prohibited by international law, he was reluctant to accept the idea that only activities entailing risk could give rise to liability, since liability should be based on the fact that harm had been caused, independent of the nature of the activity which helped produce the harm.
٧٢ - وفيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أفعال لا يحظرها القانون الدولي، قال إنه يتردد في قبول فكرة أن اﻷنشطة التي تنطوي على خطر هي وحدها التي تفضي إلى نشوء مسؤولية، من حيث أن المسؤولية يجب أن تقوم على وقوع الضرر، بمعزل عن طبيعة النشاط الذي ساهم في إنتاج هذا الضرر.

38. With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation supported a system of subsidiary liability of States for that portion of the damage not borne by whoever carried out the dangerous activity in question.
٣٨ - أما فيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أفعال لا يحظرها القانون الدولي، فإن وفده يؤيد وضع نظام للمسؤولية الفرعية للدول عن قسط الضرر الذي لا يتحمله من قام بالنشاط الخطير الذي يتعلق به اﻷمر.

23. With regard to international liability for injurious consequences arising out of acts not prohibited by international law, the Commission itself drew attention to the difficulty of finding a universally accepted concept of environment, a problem which was certain to affect efforts to define the scope of any future instruments on that topic.

With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation believed that the duty of prevention should be regarded as an obligation not of result but of conduct, as embodied in the relevant international environmental treaties.
٤٧ - ومضى يقول وفيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أفعال لا يحظرها القانون الدولي فإن وفده يرى أن واجب المنع ينبغي اعتباره التزاما بسلوك وليس التزاما بنتيجة مثلما هو مكرس في المعاهدات البيئية الدولية ذات الصلة.

With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation commended the Special Rapporteur for his treatment of the allocation of loss in case of transboundary harm arising out of hazardous activities, in particular the principles that the innocent victim should not bear the loss or injury and that the polluter should pay.
32 - واستطرد قائلا إنه فيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أعمال لا يحظرها القانون الدولي، قال إن وفده يثني على المقرر الخاص لمعالجته لمسألة من يتحمل الخسارة في حالة الضرر العابر للحدود الناجم عن أنشطة خطرة، وخصوصا المبدأ القائل بأن الضحية البريئة ينبغي ألا تتحمل الخسارة أو الضرر والمبدأ القائل بأن الملوث ينبغي أن يدفع.

With regard to international liability for injurious consequences arising out of acts not prohibited by international law, she agreed with the Working Group’s analysis of the 22 draft articles annexed to the Commission’s previous year’s report (A/51/10) and its comments on the direction of future work on the topic. “Prevention” and “liability” were the two major issues dealt with in the draft articles.

Mr. Rodríguez Vidal (Cuba) said, with regard to international liability for injurious consequences arising acts not prohibited by international law, that the prevention of transboundary damage from hazardous activities raised important questions about the delicate balance between rules on prevention and rules on liability, which should constitute an indivisible whole.

46. With regard to international liability for injurious consequences arising out of acts not prohibited by international law (prevention of transboundary damage resulting from hazardous activities), his delegation noted with satisfaction that the Commission had completed the second reading of the draft articles on that topic and had recommended the elaboration of a convention based thereon by the General Assembly.
