7.2 With regard to the author's allegation that he was subjected to arbitrary detention, the Committee has noted that the author was detained for a period of 22 months, dating from 7 February 1987, a claim that has not been contested by the State party.
7-2 وفيما يتعلق بادعاء صاحب البلاغ بأنه تعرض للاحتجاز التعسفي، فقد لاحظت اللجنة أن صاحب البلاغ احتجز لمدة 22 شهراً، اعتباراً من 7 شباط/فبراير 1987، وهو ادعاء لم تفنده الدولة الطرف.

With regard to the author's allegation that following his arrest, her husband was held in solitary confinement and incommunicado for nine days, the Committee notes that no information has been provided on the arrest and whether he was presented before a judicial authority.
وفيما يتعلق بادعاء صاحبة البلاغ أن زوجها حُبس انفرادياً لمدة تسعة أيام بعد اعتقاله، تلاحظ اللجنة عدم تقديم معلومات بشأن اعتقاله وما إذا كان قد مثل أمام سلطة قضائية أم لا.

With regard to the author's allegation that Mr. Chiti's trial suffered undue delay, the Committee notes that the information provided is very general and does not contain indications as to the circumstances under which the trial took place.
وفيما يتعلق بادعاء صاحبة البلاغ أن محاكمة السيد تشيتي تأخرت دون مبرر، تلاحظ اللجنة أن المعلومات المقدمة ذات طبيعة عامة جداً ولا تتضمن إشارات إلى الظروف التي أُجريت فيها المحاكمة.

With regard to the author's allegation of age discrimination, the State party recalls the Committee's General Comment No. 18 and its jurisprudence on age discrimination and submits that the age definition in the Saskatchewan Human Rights Code, as it existed before the legislative change in November 2007, was based on reasonable and objective criteria.

6.8 With regard to the author's allegation that he is unable to find gainful employment as a result of his conviction, the State party submits that the courts did not deprive him of the right to act as journalist.
6-8 وفيما يتعلَّق بادعاء صاحب البلاغ أنه غير قادر على إيجاد عمل يكسب منه رزقه نتيجة إدانته، تقول الدولة الطرف إن المحاكم لم تحرمه الحق في العمل كصحفي.

6.3 With regard to the author's allegation under article 9, paragraph 2, of the Covenant, the Committee concluded that the author had been aware of the grounds for his arrest.
6-3 وفيما يتعلق بادعاء صاحب البلاغ المقدم في إطار الفقرة 2 من المادة 9 من العهد، خلصت اللجنة إلى أن صاحب البلاغ كان على علم بأسباب توقيفه.

5.3 With regard to the author's allegation that the press and the public were excluded from his trial, in violation of article 14, paragraph 1, the Committee notes that the author did not raise this issue before the Supreme Court.
5-3 وفيما يتعلق بادعاء صاحب البلاغ أن الصحافة والجمهور استُبعدا من محاكمته، وهو ما يشكل انتهاكاً لأحكام الفقرة 1 من المادة 14، تلاحظ اللجنة أن صاحب البلاغ لم يثر هذه المسألة أمام المحكمة العليا.

4.2 With regard to the author's allegation that his detention under the DPSOA was arbitrary, the State party submits that his detention was lawful, reasonable and necessary in all circumstances.
4-2 وفيما يتعلق بادعاء صاحب البلاغ بأن احتجازه كان بموجب قانون السجناء الخطرين، تؤكد الدولة الطرف أن احتجازه كان قانونياً ومعقولاً وضرورياً في جميع الظروف.

8.2 With regard to the author's allegation that he was subjected to ill-treatment on 6 September 1992 by prison warders, the Committee notes that the author has made very precise allegations, including to the parliamentary ombudsman and to the Jamaica Council for Human Rights.
٨-٢ وتلاحظ اللجنة فيما يتعلق بادعاء صاحب البلاغ أنه قد تعرض لمعاملة سيئة في ٦ أيلول/سبتمبر ١٩٩٢ من جانب حراس السجن، أن صاحب البلاغ تقدم بادعاءات دقيقة جدا، بما في ذلك إلى أمين المظالم البرلماني وإلى مجلس جامايكا لحقوق اﻹنسان.

6.4 With regard to the author's allegation of discrimination by the Parole Board, the Committee notes the State party's argument that even though the author wrote to the Court Registrar enquiring into the possibility of a review of the Parole Board's decision, no formal review was ever initiated.
٦-٤ وفيما يتعلق بادعاء صاحب البلاغ بتحامل مجلس إطلاق السراح المشروط، تحيط اللجنة علما بحجة الدولة الطرف القائلة بأنه مع أن صاحب البلاغ قد كتب إلى رئيس قلم المحكمة مستفسرا عن إمكانية مراجعة قرار مجلس إطلاق السراح المشروط، لم تجر قط أي مراجعة رسمية.

8.3 With regard to the author's allegation of a violation of article 26 of the Covenant, the Committee begins by noting that Law No. 243/1992 already contained a requirement of citizenship as one of the conditions for restitution of property and that the amending Law No. 30/1996 retroactively added a more stringent requirement of continued citizenship.
8-3 وفيما يتعلق بادعاء صاحب البلاغ بحدوث انتهاك للمادة 26 من العهد، تبدأ اللجنة بملاحظة أن القانون رقم 243/1992 يتضمـن بالفعل شرط التمتع بالجنسية كواحد من شروط إعادة الممتلكات، وأن القانون المعدل لـه رقم 30/1996 يضيف بأثر رجعي شرطا أكثر تشددا يتمثل في التمتع بالجنسية بدون انقطاع.

9.9 With regard to the author's allegation that he was subjected to defamation by the Croatian authorities in Austria and Canada, the Committee notes that the State party has stated that in neither case did the author inform the Croatian authorities of his detention and that with respect to his entry into Canada he was travelling on a Slovenian passport.

6.9 With regard to the author's allegation that his application for judicial review had been illegally rejected by the regional court, the Committee notes that the Supreme Court of Ukraine considered his appeal and confirmed the decision of the regional court on 17 July 1997, and that a copy of the decision has been furnished by the State party.
6-9 أما فيما يتعلق بادعاء صاحب البلاغ القائل إن الطلب الذي قدمه بشأن إجراء مراجعة قضائية قد رفضته المحكمة الإقليمية على نحو غير قانوني، تلاحظ اللجنة أن المحكمة العليا في أوكرانيا نظرت في طلبه وأكدت قرار المحكمة الإقليمية بتاريخ 17 تموز/يوليه 1997، وأن الدولة الطرف قدمت نسخة من القرار.

10. With regard to the author's allegation of a violation of article 26 of the Covenant, the Committee notes that the Treaty on the Establishment of a Unified Germany provides for the applicability of the criminal law of the former GDR to all acts committed on the territory of the former GDR, prior to the unification becoming effective.
10- وفيما يتعلق بادعاء صاحب البلاغ وقوع انتهاك للمادة 26 من العهد، تلاحظ اللجنة أن معاهدة إنشاء دولة ألمانية متحدة تنص على ضرورة تطبيق القانون الجنائي في الجمهورية الديمقراطية الألمانية السابقة على جميع الأفعال التي ارتُكبت في إقليمها، قبل تنفيذ التوحيد.

4.3 With regard to the author's allegation of a violation under article 6, paragraph 1, of the Covenant, the State party recalls that for purposes of article 2 of the Optional Protocol, a claim is an allegation supported by substantiating material and the author must establish a prima facie case.
4-3 وفيما يتعلق بادعاء صاحب البلاغ بأن هناك انتهاكاً للفقرة 1 من المادة 6 من العهد، تذكّر الدولة الطرف، لأغراض المادة 2 من البروتوكول الاختياري، بأن الشكوى ادعاء مدعوم بأدلة مادية وينبغي لصاحب البلاغ أن يثبت وجاهة الدعوى.

4.3 The State party contends that the communication is inadmissible under article 2 of the Optional Protocol with regard to the author's allegation related to article 7 of the Covenant, since the author has failed to demonstrate that she faces a real and personal risk of being tortured or subjected to cruel, inhuman or degrading treatment if returned to Iran.
