It was further noted that the notion of " a law relating to insolvency " already provided the desirable degree of flexibility.

The utility of such study was questioned on the basis that such study would be a study of the current situation not capturing new circumstances and not taking into account that the concept of " a law relating to insolvency " was very broad.

Subparagraph (a) -- pursuant to a law relating to insolvency

(b) Brought pursuant to a law relating to insolvency, in which proceeding the assets and affairs of the debtor are subject to control or supervision by a foreign court; and
(ب) إجراء يُقام عملاً بقانون يتصل بالإعسار وتخضع فيه موجودات المدين وشؤونه لمراقبة أو إشراف محكمة أجنبية؛

The expressions " collective proceeding " , " pursuant to a law relating to insolvency " , " control or supervision by a foreign court " and " for the purpose of reorganization or liquidation " therefore needed to be defined, and this has been achieved in a clear manner in the paragraphs listed above.
ولهذا السبب كان من الضروري وضع تعاريف لعبارات: " الإجراء الجماعي " ، و " عملاً بقانون يتصل بالإعسار " ، و " المراقبة أو الإشراف من جانب محكمة أجنبية " ، و " لغرض إعادة التنظيم أو التصفية " ، وقد حددت الفقرات المذكورة أعلاه تلك التعاريف بوضوح.

(b) " Pursuant to a law relating to insolvency "

If permitted by the law relating to insolvency, an action against a director may be brought by a creditor for the benefit of the insolvency estate if the action is not brought by the insolvency representative.
ويجوز للدائن أن يرفع دعوى ضد أحد المديرين، إذا أجاز القانونُ المتعلق بالإعسار رفعَها، تحقيقاً لمنفعة حوزة الإعسار إذا لم يرفع تلك الدعوى ممثِّلُ الإعسار.

In view of that situation, article 20(2) provides that the modification or termination of the stay and the suspension provided in the article is subject to the provisions of law of the enacting State relating to insolvency.
وبالنظر إلى هذه الحالة، تنص الفقرة 2 من المادة 20 على أن يخضع تعديل أو إنهاء الوقف والتعليق المنصوص عليهما في المادة للأحكام المتعلقة بالإعسار في قانون الدولة المشترعة.

If a proceeding concerning the debtor under [insert names of laws of the enacting State relating to insolvency] has been opened, such permission may only be given after the completion of that proceeding. "

4. Paragraph 1 of this article does not affect the right to request the commencement of a proceeding under [identify laws of the enacting State relating to insolvency] or the right to file claims in such a proceeding.
٤ - لا تمس الفقرة ١ من هذه المادة بالحق في طلب بدء إجراء بموجب ]تذكر القوانين ذات الصلة باﻹعسار في الدولة المشترعة[ أو الحق في إيداع دعاوى مطالبة بالديون في مثل هذا اﻹجراء.

" 1. The law relating to insolvency should specify that from the point in time referred to in recommendation 2, the person specified in recommendation 3 will have the obligations to have due regard to the interests of creditors and other stakeholders and to take reasonable steps to:
