82. Matters relating to personal status, marriage, divorce and inheritance are governed by Islamic law, as clarified in the combined third and fourth report of the State of Kuwait.
82- إن المسائل المتعلقة بالأحوال الشخصية والمتعلقة بالزواج والطلاق والميراث تحكمها الشريعة الإسلامية وقد سبق وأن تم توضيحها في تقرير دولة الكويت الموحد الثالث والرابع.

(i) Article 9, eliminating the preference shown for the husband in the legislation relating to personal status and stipulating that the effects of the marriage shall be governed by the ordinary legislation relating to personal status;

Article 9 of the Constitution confirms the affiliation of Lebanese to spiritual families and recognizes the self-administration of each of these families and the right to legislate and pass judgement exclusively in matters relating to personal status.
فالمادة 9 من الدستور تكرّس انتماء اللبنانيين إلى عائلات روحية، وتعترف لكل من هذه العائلات بإدارة ذاتية وبحق التشريع والقضاء حصراً في الأمور المتعلّقة بالأحوال الشخصية.

131. Family law, in particular the rules relating to personal status, is a traditional topic in civil law that occupies a privileged place at the core of the academic programme. The topic includes marriage, divorce, custody, visitation, guardianship of minors, consent of the mother to the marriage of her minor child and maintenance and alimony guarantee funds.
131- من بين المواد التقليدية في القانون المدني، يحتل قانون الأسرة (خاصة القواعد المتعلقة بالأحوال الشخصية) مكانة متميّزة صلب البرنامج الدراسي، ونذكر من ذلك الزواج، الطلاق، الحضانة والزيارة، التقديم على القصر، موافقة الأم على زواج ابنها القاصر، صندوق ضمان النفقة وجراية الطلاق.

The lack of progress in amending provisions of the Penal Code on honour, or in passing specific laws in such areas as family violence, quotas, and stereotypes could be attributed to article 9 of the Constitution, which confirmed the affiliation of Lebanese to spiritual families and recognized the self-administration of each of those families and the right to legislate and pass judgement exclusively in matters relating to personal status.
ويمكن أن يُعزى عدم إحراز تقدم في تعديل أحكام القانون الجنائي المتعلقة بالشرف، أو في سَنْ قوانين محددة في مجالات مثل العنف الأسري، والحصص، والقوالب النمطية إلى المادة 9 من الدستور، التي تؤكد انتماء اللبنانيين إلى عائلات روحية، وتعترف بالإدارة الذاتية لكل عائلة من تلك العائلات، وبالحق في سن التشريعات وإصدار الأحكام في المسائل المتعلقة بالأحوال الشخصية على وجه الحصر.

108. The Court of Personal Status is the authority competent to settle marital disputes, to which the Personal Status Act No. 51 of 1984 applies. This Act regulates all matters relating to personal status, including marriage, divorce, maintenance, custody, inheritance and legacies.
108- أما بالنسبة للخلافات التي تنشأ بين الأزواج فإن محكمة الأحوال الشخصية هي الجهة المختصة بالفصل في هذا النوع من القضايا ويطبق في هذا الشأن قانون الأحوال الشخصية رقم 51 لسنة 1984 الذي ينظم كافة القواعد المتعلقة بالزواج والطلاق والنفقة والحضانة والميراث والوصية وغيرها من المسائل المتعلقة بالأحوال الشخصية.

479. The Committee welcomes the efforts undertaken to fight against gender discrimination within the framework of a national plan of action, but remains concerned by the persistence of, in particular, direct and indirect discrimination against girls and children born out of wedlock, including in areas relating to personal status (e.g. inheritance, custody and guardianship), which is incompatible with article 2 of the Convention.
479- تُرحب اللجنة بالجهود المبذولة لمكافحة التمييز بين الجنسين في إطار خطة عمل وطنية ولكن القلق ما زال يساورها، بوجه خاص لاستمرار التمييز المباشر وغير المباشر ضد البنات والأطفال المولودين خارج إطار الزواج، بما في ذلك في المجالات المتعلقة بالأحوال الشخصية (مثل الميراث والحضانة والوصاية) التي لا تتواءم مع المادة 2 من الاتفاقية.

16. In its concluding observations on Tunisia (11 June 2010), following review of the third periodic report, the Committee on the Rights of the Child expressed satisfaction at " the withdrawal by the State Party of its declaration and of reservations to article 2 of the Convention relating to personal status.....and article 7 relating to nationality " (law no. 36/2008 (9 June 2008) and ordinance no. 2503/2008 (7 July 2008)).
16- أعربت لجنة حقوق الطفل في ملاحظاتها النهائية الموجهة إلى تونس بتاريخ 11 حزيران/يونيه 2010 تبعاً لاستعراض التقرير الدوري الثالث() عن " ارتياحها لسحب الدولة العضو إعلانها وتحفظاتها فيما يخص المادة 2 المتعلقة بالأحوال الشخصية ... والمادة 7 المتعلقة بالجنسية " (القانون عدد 36 لسنة 2008 المؤرخ في 9 حزيران/يونيه 2008 والأمر عدد 2503 لسنة 2008 المؤرخ في 7 تموز/يوليه 2008).

His Government had made an interpretive declaration concerning article 23, paragraph 4, of the Covenant, which related to the rights and responsibilities of spouses as to marriage; the declaration was a positive one since there were provisions of national legislation, notably relating to personal status and in the Family Code, which evolved over time.
وإن الحكومة الجزائرية قد قدمت إعلاناً تفسيرياً بشأن الفقرة ٤ من المادة ٣٢ من العهد التي تتعلق بحقوق ومسؤوليات اﻷزواج إزاء الزواج، بمعنى إيجابي، ﻷن في التشريع الوطني، وخاصة في اﻷحوال الشخصية وقانون اﻷسرة، أحكاما هي أحكام تطورية.

6. In recent years numerous amendments have been made to the legislation in force, affecting criminal, civil, social and administrative provisions and provisions relating to personal status.
٦- تعرض التشريع الساري، خلال السنوات اﻷخيرة، لتعديلات عديدة تتعلق بالقواعد الجنائية والمدنية والاجتماعية والادارية وقواعد اﻷحوال الشخصية.

319. In Lebanon, it is necessary to distinguish between two types of provisions relating to personal status:
319- في لبنان، يجب التمييز بين نوعين من الأحكام المتعلّقة بالأحوال الشخصية.

47. The Committee notes with concern that the legal provisions relating to personal status, including marriage and its dissolution, property relations, custody and inheritance, in particular under the Personal Status Act, and the acceptance of male guardianship and dowry do not provide for equal rights of women and men and that polygamy is a direct infringement of women's rights.
47 - تلاحظ اللجنة مع القلق أن الأحكام القانونية المتصلة بالأحوال الشخصية بما في ذلك إبرام الزواج وحلّه وعلاقات الملكية والحضانة والميراث، وخاصة تلك الواردة في قانون الأحوال الشخصية، والقبول بوصاية الذّكر والمهر، لا تنص على المساواة في الحقوق بين المرأة والرجل وأن تعدد الزوجات انتهاك مباشر لحقوق المرأة.
