In the same resolution, the Commission also requested the Special Rapporteur to continue monitoring the implementation of existing standards on safeguards and restrictions relating to the imposition of capital punishment (para. 10).

30. As in previous years, the Special Rapporteur on extrajudicial, summary or arbitrary executions continued to monitor the implementation of existing international standards on safeguards and restrictions relating to the imposition of capital punishment.

The visit was prompted by a number of reports over the years citing allegations of extrajudicial executions by Jamaican security and police forces as well as by information received regarding Jamaica and the international standards on safeguards and restrictions relating to the imposition of capital punishment.
وقد جاءت هذه الزيارة نتيجة لتقديم عدد من التقارير على مر السنين تتضمن ادعاءات بحالات إعدام خارج نطاق القضاء على أيدي قوات أمن وشرطة جامايكا فضلاً عن تلقي معلومات بصدد جامايكا والمعايير الدولية بشأن الضمانات والقيود المتعلقة بتوقيع عقوبة الإعدام.

As discussed above, there are legal concerns relating to the imposition of mandatory models.

The Committee noted that, according to the Government's report, the labour inspectorate had not received any complaints relating to the imposition of pregnancy tests as a condition for obtaining or keeping a job.

55. The Commission on Human Rights has consistently requested the Special Rapporteur to monitor the implementation of all standards relating to the imposition of capital punishment.

The Special Rapporteur regrets that in a number of instances the Government's responses did not clarify whether the trial proceedings fully complied with international standards relating to the imposition of capital punishment.

114. With regard to article 4 of the Covenant, the Committee notes that, although there are provisions in the Constitution relating to the imposition of a state of emergency, no legislation has yet been adopted in conformity with the requirements of the Covenant.
١١٤ - وفيما يتعلق بالمادة ٤ من العهد، تلاحظ اللجنة أنه رغم وجود أحكام في الدستور تتصل بفرض حالة الطوارئ، فلم يعتمد بعد أي تشريع يتفق مع متطلبات العهد.

312. Section 6 of the Penal Code (amended) No. 111 (1969) deals with shameful acts that violate decency in articles 400 to 404, relating to the imposition of penalties on any person who commits an indecent act without consent, as follows:
312- نص الفصل السادس من قانون العقوبات المعدل رقم 111 لسنة 1969 المعنون بالفعل الفاضح المخل بالحياء في المواد (400) (401) (402) (403) (404) وهي مواد تتعلق بفرض عقوبات على كل من ارتكب فعلاً مخلاً بالحياء بغير رضاه أو رضاها وعلى النحو الآتي:

(g) To monitor the implementation of international standards, including safeguards and restrictions, relating to the imposition of capital punishment, bearing in mind the comments made by the Human Rights Committee in its interpretation of article 6 of the International Covenant on Civil and Political Rights, as well as the Second Optional Protocol thereto.
(ز) رصد تنفيذ المعايير الدولية، بما في ذلك الضمانات والقيود، المتصلة بتوقيع عقوبة الإعدام، مع مراعاة تعليقات اللجنة المعنية بحقوق الإنسان في تفسيرها للمادة 6 من العهد الدولي الخاص بالحقوق المدنية والسياسية، فضلاً عن البروتوكول الاختياري الثاني الملحق به.

48. Please comment on the concerns expressed by the Special Rapporteur on extrajudicial, summary or arbitrary executions concerning non-respect of international standards relating to the imposition of capital punishment.
48- ويرجى التعليق على المخاوف التي أعرب عنها المقرر الخاص المعني بحالات الإعدام خارج القضاء أو بإجراءات موجزة أو تعسفاً بشأن عدم احترام المعايير الدولية الخاصة بفرض عقوبة الإعدام.

The practical value of sanctions should be weighed against the harm they did to the population; moreover, consideration should be given to putting in place a legal framework that would clearly address the various formal and substantive issues relating to the imposition of sanctions, including that of compensation.
كما أن القيمة العملية للجزاءات ينبغي موازنتها مقابل الضرر الذي تسببه بالنسبة للسكان. وفضلاً عن ذلك ينبغي إيلاء الاعتبار لوضع إطار قانوني يكفل بوضوح معالجة القضايا الإجرائية والموضوعية المختلفة المتصلة بفرض الجزاءات بما في ذلك قضية التعويض.
