This problem can be solved very simply. The text of article 12 (3) can become a separate provision, notably article 13 (new) with a heading such as " Failure to act and impossibility to perform " ; the present articles 13-14 on the replacement of an arbitrator can be combined into a new article 14.
ويمكن حلّ هذه المشكلة ببساطة شديدة، وذلك بجعل نص المادة 12 (3) حكما مستقلا، وبالأخص تحويله إلى المادة 13 (جديدة) على أن يكون عنوانها من قبيل " عدم القيام بمهام العمل واستحالة أدائه " ؛ ويمكن تجميع المادتين الحاليتين 13 و14 حول تبديل أحد المحكّمين لتصبحا المادة 14 الجديدة.
