The optional language for an ex ante approval of direct solicitation in request-for-proposals proceedings has been deleted.

It was observed that the modified version referred, in addition to tendering proceedings, to request-for-proposals proceedings and to the special procedures for services under article 39 bis, though not to competitive negotiation.

Article 35. Solicitation in request-for-proposals proceedings

2. The procuring entity may engage in direct solicitation in request-for-proposals proceedings if:

(e) A refusal by the procuring entity to respond to an expression of interest in participating in request-for-proposals proceedings pursuant to article 48 (2);

1. An invitation to participate in request-for-proposals proceedings shall be published in accordance with paragraphs 1 and 2 of article 33 of this Law, except where:

3. The procuring entity shall include in the record required under article 25 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of direct solicitation in request-for-proposals proceedings.

4. The procuring entity shall cause a notice of the procurement to be published in accordance with the requirements set out in paragraph 5 of article 34 of this Law when it engages in direct solicitation in request-for-proposals proceedings.
4- تتكفل الجهة المشترية بنشر إشعار بالاشتراء وفقاً للمتطلبات المبيّنة في الفقرة 5 من المادة 34 من هذا القانون حيثما تقوم بالالتماس المباشر في إجراءات طلب الاقتراحات.

There are examples in practice of effective procurement of complex subject matter using framework agreements combined with dialogue-based request-for-proposals methods, such as for the procurement of satellite equipment and specialized communications devices for law enforcement agencies.
وثمة أمثلة عملية على الاشتراء الفعّال لبنود معقدة باستخدام الاتفاقات الإطارية مقترنة بطرائق طلب الاقتراحات المقترن بحوار، كما في حالة اشتراء المعدات الساتلية وأجهزة الاتصالات المتخصصة لصالح أجهزة إنفاذ القانون.

This would be typically in request-for-proposals proceedings because the latter have traditionally been used for procurement of " intellectual type of services " (such as architectural, legal, medical, engineering).
وينطبق ذلك عادة على إجراءات طلب الاقتراحات نظرا لأنَّ العادة جرت على استخدام هذه الأخيرة من أجل اشتراء " خدمات من النوع الفكري " (مثل الخدمات المعمارية والقانونية والطبية والهندسية).

As noted in paragraph ... above, the 2011 Model Law provides for three types of request-for-proposals proceedings (request for proposals without negotiation, request for proposals with dialogue and request for proposals with consecutive negotiations).

The provisions of paragraph (2) regulating the publication of a notice seeking expressions of interest are not found in the 2011 Model Law in the context of any request-for-proposals proceedings.
56- ولم ترِد أحكام الفقرة (2) التي تنظّم نشر إعلان يُطلَب فيه بيان الرغبة في القانون النموذجي لعام 2011 في سياق أيٍّ من إجراءات طلب الاقتراحات.

The first stage in the request-for-proposals proceedings in the 2011 Model Law is regulated in article 35 (on solicitation in request-for-proposals proceedings) where several options for solicitation are provided.
57- وتنظم المادة 35 من القانون النموذجي لعام 2011 (بشأن الالتماس في إجراءات طلب الاقتراحات) التي تورد جملة من خيارات الالتماس، المرحلة الأولى من إجراءات طلب الاقتراحات.

The provisions of the 2011 Model Law regulating request-for-proposals proceedings do not include any specific provisions on evaluation criteria (unlike paragraph (3) of the 1994 text).
59- ولا تتضمن الأحكام التي تنظم إجراءات طلب الاقتراحات في القانون النموذجي لعام 2011 أيَّ أحكام محدَّدة بشأن معايير التقييم (بخلاف الفقرة (3) من نص قانون 1994).

The 2011 Model Law has also introduced conditions for use of two other request-for-proposals types of proceedings (not found in the 1994 Model Law): request for proposals without negotiation, and request for proposals with consecutive negotiations (see articles 29(3) and 30(3) of the 2011 text).
71- كما أحدث القانون النموذجي لعام 2011 شروط استخدام نوعين آخرين من إجراءات طلب الاقتراحات (غير موجودين في القانون النموذجي لعام 1994)، وهما طلب الاقتراحات غير المقترن بتفاوض وطلب الاقتراحات المقترن بمفاوضات متعاقبة (انظر المادتين 29(3) و30(3) من نصّ عام 2011).

While supporting the suggestions described in the preceding paragraph, concerns were expressed that the resulting guidance should not convey the idea that output-based specifications were relevant only in request-for-proposals proceedings and not in tendering.
64- ولئن حظيت الاقتراحات الواردة في الفقرة السابقة بالتأييد، فقد أُعرب في الوقت نفسه عن الانشغال لأنَّ التوجيهات التي تستتبعها ينبغي ألاّ توحي بأنَّ المواصفات الوظيفية لا تكون مهمة إلا في إجراءات طلب الاقتراحات وليس في سياق المناقصة.

As noted in paragraphs 34-35 above, certain provisions of article 11 of the 2011 text have been drafted to accommodate the special features of request-for-proposals proceedings, such as the need to take into account the experience, reliability and professional and managerial competence of the supplier or contractor and of the personnel to be involved in providing the subject matter of the procurement.
وكما ورد في الفقرتين 34 و35 أعلاه، فقد صيغت بعض أحكام المادة 11 من نص قانون 2011 لتستوعب السمات الخاصة لإجراءات طلب الاقتراحات من قبيل ضرورة الأخذ في الاعتبار خبرة المورِّد أو المقاول ومدى موثوقيته وكفاءته المهنية والإدارية، وكذلك خبرة وموثوقية وكفاءة العاملين الذين سيقومون بتوفير الشيء موضوع الاشتراء.

It was also suggested that in the same provision the reference to " request for proposals " should instead be a reference to " request-for-proposals proceedings " .
واقترح أيضا أن اﻹشارة في النص نفسه الى " طلب تقديم الاقتراحات " ينبغي أن تكون بدلا من ذلك إشارة الى " إجراءات طلب تقديم الاقتراحات " .
