“2 bis. The requesting State Party shall not use any information received that is protected by bank secrecy for any purpose other than the proceedings for which that information was requested, unless authorized by the Requested State Party.”
" ٢ مكررا - لا يجوز للدولة الطرف الطالبة أن تستخدم المعلومات التي حصلت عليها والتي تكون محمية بقانون سرية المصارف ﻷي غرض آخر سوى اﻹجراءات التي طلبت من أجلها تلك المعلومات، ما لم تأذن بذلك الدولة الطرف المطلوبة منها. "

وعلى الدولة الطرف الطالبة أن تحترم كل الاحترام سرية تلك التقارير.

1 - لا يجوز للدولة الطرف الطالبة أن تستخدم أو تحيل، دون موافقة الدولة الطرف الموجه إليها الطلب، معلومات أو أدلة قدمتها الدولة الطرف الموجه إليها الطلب لأغراض تحقيقات أو إجراءات قضائية أخرى خلاف تلك التي ينص عليها الطلب.

14. The requesting State Party shall not transmit nor use information or evidence furnished by the requested Party for investigations, prosecutions or proceedings other than those stated in the request without the prior consent of the requested Party. One delegation proposed that the use of evidence be restricted only when the requested State so indicated.
٤١ - لا يجوز للدولة الطرف الطالبة أن تنقل المعلومات أو اﻷدلة التي زودها بها الطرف متلقي الطلب أو أن تستخدمها في تحقيقات أو ملاحقات أو إجراءات غير تلك المذكورة في الطلب ، دون موافقة مسبقة من الطرف متلقي الطلب .اقترح أحد الوفود عدم تقييد استخدام اﻷدلة الا عندما تبين ذلك الدولة متلقية الطلب .

14. The requesting State Party shall not transmit nor use information or evidence furnished by the requested Party for investigations, prosecutions or proceedings other than those stated in the request without the prior consent of the requested Party.
٤١ - لا يجوز للدولة الطرف الطالبة ، دون موافقة مسبقة من الطرف متلقي الطلب ، أن تحول المعلومات أو اﻷدلة التي زودها بها الطرف متلقي الطلب أو أن تستخدمها في تحقيقات أو ملاحقات أو إجراءات قضائية غير تلك التي وردت في الطلب .

In situations where the State under review has not exercised its sovereign right to publish its country review report or parts thereof as set forth in paragraph 39, the requesting State Party shall fully respect the confidentiality of such reports or parts thereof.
وفي الحالات التي لا تمارس فيها الدولة المُستعرَضة حقها السيادي في نشر تقرير استعراضها القُطري أو نشر جزء منه على النحو المبيّن في الفقرة 39، يتعيّن على الدولة الطرف الطالبة أن تحترم كل الاحترام سرّية تلك التقارير أو سرّية أجزاء منها.

In situations where the State under review has not exercised its sovereign right to publish its country review report or parts thereof as set forth in paragraph 39, the requesting State Party shall fully respect the confidentiality of such reports or parts thereof. (Preliminary acceptance)
وفي الحالات التي لا تمارس فيها الدولة المُستعرَضة حقها السيادي في نشر تقرير استعراضها القُطري أو نشر جزء منه على النحو المبيّن في الفقرة 39، يتعيّن على الدولة الطرف الطالبة أن تحترم كل الاحترام سرّية تلك التقارير أو سرّية أجزاء منها. (قبول أولي)
