وفي حال عدم وجود تلك المعارضة، تنطبق المعاهدة بين صاحب التحفظ وصاحب الاعتراض بالقدر المنصوص عليه في التحفظ والاعتراض.

Ultimately, therefore, the rules applicable as between the author of the reservation and the author of the objection are never different from those that pre-dated the treaty and, unless application of the treaty as a whole is excluded, from treaty-based provisions not affected by the reservation.
فالقواعد السارية بين صاحب التحفظ وصاحب الاعتراض لا تختلف في النهاية عن تلك التي سبقت وجود المعاهدة، ولا عن الأحكام التعاهدية التي لم يرد عليها تحفظ ما لم يُستبعد تطبيق المعاهدة برمتها.

That was not, however, the only consequence of an objection, which could also have an effect both on the entry into force of the treaty and on the content of treaty relations between the author of the reservation and the author of the objection.
إلا أن هذه النتيجة ليست النتيجة الوحيدة للاعتراض الذي يمكن أن يكون له أيضاً أثر على بدء نفاذ المعاهدة وعلى مضمون العلاقات التعاهدية بين صاحب التحفظ وصاحب الاعتراض.

The Commission considered that the widening of the scope of an objection cannot call into question the very existence of treaty relations between the author of the reservation and the author of the objection.
فقد رأت اللجنة أن توسيع نطاق الاعتراض لا يمكن أن يخل بوجود العلاقات التعاهدية بين الجهة صاحبة التحفظ والجهة صاحبة الاعتراض.
