344 - وتفسير التحفظ بالتالي هو وحده القادر على أن يساعد في تحديد أحكام المعاهدة، أو أجزاء هذه الأحكام، التي تتوخى الدولة المتحفظة أو المنظمة الدولية المتحفظة استبعاد أو تعديل أثرها القانوني.

Thus, the withdrawal of an objection became operative only when notice of it had been received by the reserving State or international organization, even if the effects of withdrawal of an objection might go beyond the strictly bilateral relationship between the reserving party and the objecting party.
وهكذا، فإن سحب الاعتراض لا يصبح ساريا إلا بعد استلام الدولة أو المنظمة الدولية المتحفظة لإشعار به، حتى لو كانت آثار سحب الاعتراض تتجاوز العلاقة الثنائية البحتة بين الطرف المتحفظ والطرف المعترض.

1. A reservation established with regard to another party excludes or modifies for the reserving State or international organization in its relations with that other party the legal effect of the provisions of the treaty to which the reservation relates or of the treaty as a whole with respect to certain specific aspects, to the extent of the reservation.
1 - إن إنشاء التحفظ إزاء طرف آخر يستبعد أو يعدل بالنسبة إلى الدولة المتحفظة أو المنظمة الدولية المتحفظة، في علاقاتها مع ذلك الطرف الآخر، الأثر القانوني لأحكام المعاهدة التي يتعلق بها التحفظ أو الأثر القانوني للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة، وبحدود ذلك التحفظ.

1. The status of the author of an invalid reservation in relation to a treaty depends on the intention expressed by the reserving State or international organization on whether it intends to be bound by the treaty without the benefit of the reservation or whether it considers that it is not bound by the treaty.
1 - يتوقف وضع صاحب التحفظ غير الصحيح بالنسبة إلى المعاهدة على النية التي تعرب عنها الدولة المتحفظة أو المنظمة الدولية المتحفظة بشأن ما إذا كانت تعتزم الالتزام بالمعاهدة بدون الاستفادة من التحفظ أم كانت تعتبر نفسها غير ملزمة بالمعاهدة.

4. If a treaty monitoring body expresses the view that a reservation is invalid and the reserving State or international organization intends not to be bound by the treaty without the benefit of the reservation, it should express its intention to that effect within a period of twelve months from the date at which the treaty monitoring body made its assessment.
4 - إذا رأت هيئة رصد المعاهدة أن التحفظ غير صحيح وكانت الدولة المتحفظة أو المنظمة الدولية المتحفظة تعتزم عدم الالتزام بالمعاهدة بدون الاستفادة من التحفظ، ينبغي لها أن تعرب عن هذه النية في غضون الاثني عشر شهرا التالية لتاريخ إعلان هيئة رصد المعاهدة رأيها.

4. If a treaty monitoring body expresses the view that a reservation is invalid and the reserving State or international organization intends not to be bound by the treaty without the benefit of the reservation, it should express its intention to that effect within a period of twelve months from the date at which the treaty monitoring body made its assessment.

4. If a treaty monitoring body expresses the view that a reservation is invalid and the reserving State or international organization intends not to be bound by the treaty without the benefit of the reservation, it should express its intention to that effect within a period of twelve months from the date at which the treaty monitoring body made its assessment.
4- إذا رأت هيئة رصد المعاهدة أن التحفظ غير صحيح وكانت الدولة المتحفظة أو المنظمة الدولية المتحفظة تعتزم عدم الالتزام بالمعاهدة بدون الاستفادة من التحفظ، ينبغي لها أن تعرب عن هذه النية في غضون الاثني عشر شهراً التالية لتاريخ إعلان هيئة رصد المعاهدة رأيها.

(31) Only an interpretation of the reservation can thus help in determining the provisions of the treaty, or the parts of these provisions, whose legal effect the reserving State or international organization purports to exclude or modify.
31) وتفسير التحفظ بالتالي هو وحده الذي يمكن أن يساعد في تحديد أحكام المعاهدة، أو أجزاء هذه الأحكام، التي تتوخى الدولة المتحفظة أو المنظمة الدولية المتحفظة استبعاد أو تعديل أثرها القانوني.

The withdrawal of a reservation entails the entry into force of the treaty in the relations between the State or international organization which withdraws the reservation and a State or international organization which had objected to the reservation and opposed the entry into force of the treaty between itself and the reserving State or international organization by reason of that reservation.
ويترتب على سحب تحفظ دخول المعاهدة حيز النفاذ في العلاقات بين الدولة أو المنظمة الدولية التي سحبت التحفظ والدولة أو المنظمة الدولية التي كانت قد اعترضت على التحفظ وعلى دخول المعاهدة حيز النفاذ بينها وبين الطرف المتحفظ بسبب هذا التحفظ.

Following such a finding, the reserving State or international organization must take action accordingly.
وإذ حدث هذا الاستنتاج، وجب على الدولة أو المنظمة الدولية التي أبدت التحفظ أن تستخلص النتائج المترتبة عليه.

" Enlargement of the scope of a reservation means a modification for the purpose of excluding or modifying the legal effect of certain provisions of the treaty, or of the treaty as a whole with respect to certain specific aspects in their application to the reserving State or international organization, in a broader manner than the initial reservation. "
" المقصود بتشديد أثر التحفظ هو تعديل يهدف إلى استبعاد أو تعديل الأثر القانوني لأحكام معينة في معاهدة أو للمعاهدة بأكملها في حالات معينة، من حيث انطباقها على الدولة أو المنظمة الدولية التي تبدي التحفظ بشكل أوسع نطاقا من التحفظ الذي أبدي في الأصل " .

A reservation formulated when signing a treaty, where the treaty makes express provision for an option on the part of a State or an international organization to formulate a reservation at such a time, does not require formal confirmation by the reserving State or international organization when expressing its consent to be bound by the treaty.
لا يتطلب التحفظ الذي يقدم عند التوقيع على المعاهدة تأكيدا رسميا، إذا ما كانت المعاهدة تنص صراحة على حق الدولة أو المنظمة الدولية في إعلان تحفظ في هذه المرحلة، وذلك عند إعراب الدولة أو المنظمة الدولية الواضعة للتحفظ عن ربط موافقتها به.
