22. Two kinds of interventions can be used by the State authorities for dealing with children alleged as, accused of, or recognized as having infringed the penal law: measures without resorting to judicial proceedings and measures in the context of judicial proceedings.

(s) The generally limited use of measures not resorting to judicial proceedings dealing with children alleged as, accused of, or recognized as having infringed penal law;

CRC recommended, inter alia, that children be detained separately from adults and that alternative measures be promoted for dealing with children without resorting to judicial proceedings.

68. The Committee on the Rights of the Child has called upon States to both take measures to address juvenile crimes without resorting to judicial proceedings wherever possible and also to support traditional restorative justice systems to the extent they promote the best interests of the child.

In the opinion of the Committee, the obligation of States parties to promote measures for dealing with children in conflict with the law without resorting to judicial proceedings applies, but is certainly not limited to children who commit minor offences, such as shoplifting or other property offences with limited damage, and first-time child offenders.
