Immigration judges applied the standard " more likely than not " provision in implementing article 3 of the Convention against Torture, and thus determined whether it was probable that a foreign national would be tortured if he was returned or extradited to a particular country.

Bearing in mind that the State party and the Committee are obliged to assess whether there are substantial grounds for believing that the author would be in danger of being subjected to torture were he/she to be expelled, returned or extradited, the risk of torture must be assessed on grounds that go beyond mere theory or suspicion.
٦ - إذا وضع في الاعتبار أن على الدولة الطرف واللجنة إلتزاما بتقدير ما إذا كانت هناك أسباب جوهرية للاعتقاد بأن الفاعل سيتعرض لخطر التعذيب إذا طرد أو أعيد أو سلم، يجب أن يقدر خطر التعذيب على أسس تتجاوز مجرد النظرية أو الشك.

It means that no person shall be rejected, returned or extradited to a territory where his life, physical integrity or liberty would be threatened.
ويفيد هذا المبدأ بأنه لا يجوز رفض أو إعادة أو ترحيل أي شخص إلى إقليم تكون فيه حياته أو سلامته الجسدية أو حريته مهددة.

The State party should ensure that no person is expelled, returned or extradited to a country where there are substantial grounds for believing that he/she would be in danger of being subjected to torture.
ينبغي للدولة الطرف أن تضمن عدم طرد أي شخص أو إعادته أو تسليمه إلى بلد توجد أُسس حقيقية تحمل على الاعتقاد بأنه قد يتعرض فيه للتعذيب.

وتشير اللجنة إلى تعليقها العام رقم 1 المتعلق بالمادة 3 الذي جاء فيه أن على اللجنة أن تقيّم ما إذا كانت توجد أسباب حقيقية للاعتقاد بأن صاحب الشكوى سيواجه خطر التعرض للتعذيب إذا ما طُرد أو أُعيد أو سُلِّم، وأن خطر التعرض للتعذيب يجب تقييمه على أسس تتجاوز مجرد الافتراض والشك.

The State Party should also ensure that, in practice, foreigners are not expelled, returned or extradited under any circumstances to countries where there are substantial grounds for believing that the person would be in danger of being subjected to torture in the country of destination.
كما ينبغي لها أن تضمن فعلياً عدم طرد الأجانب أو إعادتهم أو تسليمهم في ظل أي ظروف إلى بلدان تتوفر فيها أسباب قوية تدعو إلى الاعتقاد بأن الشخص المعني سيتعرض لخطر التعذيب في بلد المقصد.

Noting the responsibility of requesting and requested States parties to cooperate to ensure that a greater proportion of the proceeds emanating from corruption are recovered, returned or otherwise disposed of in accordance with the provisions of the Convention,

6. The State party should always assess its nonrefoulement obligations under article 3 of the Convention on an individual basis and provide, in practice, all procedural guarantees to the person expelled, returned or extradited.
