4.3 With regard to article 3 of the Convention, the State party submits that, pursuant to general comment No. 1, this provision places the burden upon the complainant to establish that he would be at risk of being tortured if returned to India.

8.6 In the light of the foregoing, the Committee concludes that the complainant has failed to establish a personal, present and foreseeable risk of being tortured if he were to be returned to India.
8-6 في ضوء ما سبق، تخلص اللجنة إلى أن صاحب الشكوى لم يثبت وجود خطر ماثل ومتوقع بالتعرض شخصياً للتعذيب إذا ما تقررت إعادته إلى الهند.

4.10 The State party maintains that there are no serious reasons to fear that the complainants would be exposed to real, concrete and personal risk of being tortured if returned to India.
4-10 وتؤكد الدولة الطرف عدم وجود أسباب وجيهة للخوف من أن يواجه أصحاب البلاغ خطر التعرض للتعذيب بصورة حقيقية وملموسة وشخصية في حالة ترحيلهم إلى الهند.
