From a legal standpoint, it is undesirable to retain a system which makes the Review of Administrative Tribunal Judgements dependent on the decisions taken by the Committee on Application for Review of Administrative Tribunal Judgements, which is not a jurisdictional body.

1. At its forty-first session, the Committee on Applications for Review of Administrative Tribunal Judgements, established under article 11 of the statute of the Administrative Tribunal, considered the following applications:
١ - نظرت اللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية المنشأة بموجب المادة ١١ من النظام اﻷساسي للمحكمة اﻹدارية في الطلبات التالية خلال دورتها الحادية واﻷربعين:

1. The 1st meeting of the forty-sixth session of the Committee on Applications for Review of Administrative Tribunal Judgements will take place at United Nations Headquarters on Tuesday, 27 February 1996.
١ - ستُعقد الجلسة اﻷولى للدورة السادسة واﻷربعين للجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية في مقر اﻷمم المتحدة يوم الثلاثاء، ٢٧ شباط/فبراير ١٩٩٦.

The Review of Administrative Tribunal Judgements should perhaps be one of the issues dealt with by the General Assembly in that context, and it was hoped that no decision would be made before all the parties concerned had an opportunity to comment on possible changes.
أما مراجعة أحكام المحكمة اﻹدارية فإنها قد ينبغي أن تكون إحدى المسائل التي تتناولها الجمعية العامة في هذا السياق، ومن المأمول ألا يتم اتخاذ أي قرار قبل أن تتاح الفرصة لجميع اﻷطراف المعنية للتعليق على التغييرات المحتملة.

It is worth recalling that under the present system, decisions of the Administrative Tribunal can be reviewed only by means of an advisory opinion of the International Court of Justice and that the only organ which can request such an opinion is the Committee on Applications for Review of Administrative Tribunal Judgements.
وتجدر اﻹشارة الى أن أحكام المحكمة اﻹدارية لا يمكن مراجعتها في ظل نظامها القائم حاليا إلا بموجب فتوى تصدرها محكمة العدل الدولية بناء على طلب لا يحق التماسه لغير اللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية.

2. Ireland, as a Member State whose representatives served on the General Committee of the forty-sixth and forty-seventh sessions of the General Assembly, was a member of the Committee on Applications for Review of Administrative Tribunal Judgements for two terms under the provisions of article 11.4 of the statute of the Tribunal.

However, they may, if the Committee on Applications for Review of Administrative Tribunal Judgements so decides, be submitted to the International Court of Justice (ICJ) for an advisory opinion. 12/

At its forty-fifth session the General Assembly, by its resolution 45/239 B of 21 December 1990, requested the Secretary-General to undertake a study of the overall system of administration of justice in the Secretariat, taking into account, inter alia, suggestions made by Member States regarding the functioning of the Committee on Applications for Review of Administrative Tribunal Judgements.
١ - طلبت الجمعية العامة، في دورتها الخامسة واﻷربعين، بموجب قرارها ٤٥/٢٣٩ باء، إلى اﻷمين العام أن يجري دراسة لمجمل نظام إقامة العدل في اﻷمانة العامة، آخذا في اعتباره، في جملة أمور، الاقتراحات التي قدمتها الدول اﻷعضاء بشأن أداء اللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية.

20. In addition to the United Nations (General Assembly, Security Council, Economic and Social Council, Trusteeship Council, Interim Committee of the General Assembly, Committee on Applications for Review of Administrative Tribunal Judgements), the following organizations are at present authorized to request advisory opinions of the Court on legal questions:
٢٠ - باﻹضافة إلى اﻷمم المتحدة )الجمعية العامة، ومجلس اﻷمن، والمجلس الاقتصادي والاجتماعي، ومجلس الوصاية، واللجنة المؤقتة التابعة للجمعية العامة، واللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية(، فإن المنظمات التالية مأذون لها حاليا بطلب فتوى من المحكمة في المسائل القانونية:

Mr. HAYES (Ireland) said that his delegation had had the opportunity to serve on the Committee on Applications for Review of Administrative Tribunal Judgements, established under article 11 of the statute of the Administrative Tribunal of the United Nations, which was authorized to request advisory opinions of the International Court of Justice.
١ - السيد هيز )ايرلندا(: قال إن وفده تسنت له فرصة الخدمة في " اللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية " ، المنشأة عملا بالمادة ١١ من النظام اﻷساسي للمحكمة اﻹدارية لﻷمم المتحدة، وهي مخولة سلطة طلب الفتاوى من محكمة العدل الدولية.

5. Paragraph 4 of article 11 provides for the establishment of a Committee on Applications for Review of Administrative Tribunal Judgements (hereafter " the Committee on Applications " ), which is authorized by the General Assembly under paragraph 2 of article 96 of the Charter to request advisory opinions of the International Court of Justice.
٥ - وتنص الفقرة ٤ من المادة ١١ على إنشاء لجنة معنية بطلبات مراجعة أحكام المحكمة اﻹدارية )وترد أدناه تحت اسم " اللجنة المعنية بالطلبات " (، ترخص لها الجمعية العامة بموجب الفقرة ٢ من المادة ٩٦ من الميثاق بطلب الفتاوى من محكمة العدل الدولية.

2. The Tribunal may dismiss an application, in which case the award of the Arbitration Board would become final (subject to the procedure in article 11 of the statute, which permits a party to submit an application to the Committee on Applications for Review of Administrative Tribunal Judgements).
٢ - ويجوز أن ترفض المحكمة طلبا وفي هذه الحالة يصبح قرار مجلس التحكيم نهائيا )رهنا باﻹجراء الوارد في المادة ١١ من النظام اﻷساسي الذي يجيز ﻷحد اﻷطراف تقديم طلب إلى اللجنة المعنية بطلبات مراجعة أحكام المحكمة اﻹدارية(.

In this connection, the Committee recalls that the General Assembly, in its resolution 50/54, deleted article 11 of the statute of the Administrative Tribunal of the United Nations, thus, inter alia, abolishing the Committee on Applications for Review of Administrative Tribunal Judgements.
وتشير اللجنة في هذا الصدد إلى أن الجمعية حذفت في قرارها 50/54 المادة 11 من النظام الأساسي للمحكمة الإدارية للأمم المتحدة، فألغت بذلك، في جملة أمور، اللجنة المعنية بطلبات إعادة النظر في أحكام المحكمة الإدارية.
