The Chapter VIII of the Action Plan prescribes measures for protection of right to freedom from torture or other cruel, inhuman or degrading treatment or punishment, the English Reference of which is annexed to this information.
ويوصي الفصل الثامن من خطة العمل باتخاذ تدابير لحماية الحق في عدم التعرض للتعذيب أو لغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، المرفق نصه الإنكليزي بهذا التقرير.

Article 36 of the Constitution guarantees the right to freedom from torture or degrading treatment. It expressly states: " Personal freedom shall be assured. No one may be arrested, imprisoned, searched, compelled to reside at a given location or have his freedom of residence or movement curtailed, except in accordance with the law.
كفلت المادة 36 من الدستور الحق والحرية في عدم التعرض للتعذيب أو للمعاملة الحاطة بالكرامة، فقد نصت المادة صراحة على أن " الحرية الشخصية مكفولة ولا يجوز القبض على إنسان أو حبسه أو تفتيشه أو تحديد إقامته أو تقييد حريته في الإقامة أو التنقل إلا وفق أحكام القانون.

Therefore, certain rights could not be infringed in Uganda, including the right to freedom from torture and other cruel, inhuman or degrading treatment or punishment, the right to freedom from slavery or servitude, the right to a fair trial and the right to habeas corpus.
وعليه، فإن بعض الحقوق لا تعاني من أي انتهاكات في أوغندا مثل: الحق في عدم التعرض للتعذيب أو أشكال أخرى من المعاملة القاسية أو اللاإنسانية أو المهينة، والحق في عدم التعرض للرق أو العبودية، والحق في المحاكمات العادلة، والحق في رفع الدعاوى.

B. right to freedom from torture and cruel, inhuman or degrading treatment or punishment 36. The right to freedom from torture and cruel, inhuman or degrading treatment or punishment is non-derogable under all circumstances.
36 - إن الحق في عدم التعرض للتعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة حق لا يجوز عدم التقيد به أيا كانت الظروف.

It further affirmed that the right to freedom from torture should be protected in all circumstances, including in times of internal or international disturbance or armed conflict, and insisted on the need to eliminate impunity.
وأكد كذلك الحق في عدم التعرض للتعذيب حق ينبغي أن توفر له الحماية في كل الظروف، بما في ذلك في أوقات الاضطرابات الداخلية أو الدولية أو النـزاع المسلح وأصر على ضرورة القضاء على إفلات المذنبين بانتهاكه من العقاب.

As is clear from article 36, the right to freedom from torture and the right to freedom from degrading treatment are protected under the Constitution as inderogable rights that may not be revoked or suspended.
يتضح من نص المادة 36 أنها أفردت حماية دستورية على الحق والحرية في عدم التعرض للتعذيب وأيضاً الحق والحرية في عدم التعرض للمعاملة الحاطة بالكرامة، وعلى وجه لا يقبل الانتقاص أو الإلغاء أو التعليق وفقاً لنص المادة.
