In order to prevent violations of the rights of children deprived of their liberty, States are required to establish certain safeguards.
30- حرصاً على منع انتهاكات حقوق الأطفال المحرومين من حريتهم، يجب على الدول إقرار ضمانات معينة.

The Committee stressed that particular attention should be paid to considering deprivation of liberty only as a measure of last resort and for the shortest possible period of time, to the protection of the rights of children deprived of their liberty, to due process of law and to the full independence and impartiality of the judiciary.
وشددت اللجنة على ضرورة إيلاء اهتمام خاص لاعتبار الحرمان من الحرية كملجأ أخير فقط ولأقصر فترة زمنية ممكنة، ولحماية حقوق الأطفال المحرومين من حريتهم، ولمراعاة أصول المحاكمة العادلة، وللاستقلال التام والحيدة الكاملة لجهاز القضاء.

Particular attention should be paid to considering deprivation of liberty only as a measure of last resort and for the shortest possible period of time, to the protection of all the rights of children deprived of their liberty and, when appropriate, to encouraging alternatives to the processing of cases through the regular penal system.
وينبغي إيلاء عناية خاصة لجعل الحرمان من الحرية تدبيراً من تدابير الملاذ الأخير وأن يكون لأقصر فترة زمنية ممكنة، ولحماية كافة حقوق الأطفال المحرومين من حريتهم، والتشجيع، حسبما يكون مناسبا، على اعتماد بدائل لعملية معالجة القضايا عن طريق النظام العقابي العادي.

Particular attention should be paid to considering deprivation of liberty only as a measure of last resort and for the shortest possible period of time to protecting the rights of children deprived of their liberty and to expanding the juvenile justice system to ensure full coverage throughout the State party.
وينبغي إيلاء اهتمام خاص لاعتبار الحرمان من الحرية تدبيراً يطبق كملاذ أخير ولأقصر فترة ممكنة من الوقت من أجل حماية حقوق الأطفال المحرومين من حريتهم، ولتوسيع نظام قضاء الأحداث ليشمل كافة أنحاء الدولة الطرف.

Protect the rights of children deprived of their liberty and monitor their conditions of detention;
(ﻫ) حماية حقوق الأطفال المحرومين من حريتهم ورصد ظروف احتجازهم؛

International norms and standards require the establishment of appropriate independent monitoring and complaint mechanisms as well as of other safeguards in order to prevent violations of the rights of children deprived of their liberty.
57- وتقتضي القواعد والمعايير الدولية إنشاء آليات مناسبة ومستقلة للرصد والتظلم وإقرار ضمانات أخرى لمنع انتهاكات حقوق الأطفال المحرومين من حريتهم.

The full-day meeting consisted of two panels: the morning panel, which focused on children in the judicial process, worrying trends and good practices, and the afternoon panel, which was devoted to the protection and realization of the rights of children deprived of liberty and children of incarcerated parents.

26. Calls upon States to consider establishing or strengthening existing independent and child-friendly national monitoring and complaints mechanisms to contribute to safeguarding the rights of children deprived of their liberty;

915. The Committee also urges the State party to take immediate measures to protect the rights of children deprived of their liberty, by providing legal assistance to children and by improving conditions in places of detention, including pre-trial detention centres and educational colonies.
915- وتحث اللجنة أيضا الدولة الطرف على اتخاذ تدابير فورية لحماية حقوق الأطفال المحرومين من حريتهم، بتوفير المساعدة القانونية للأطفال وبتحسين الظروف في أماكن الاحتجاز، بما في ذلك مراكز الاحتجاز السابق للمحاكمة والمستعمرات التربوية.

The Committee recommends that the State party, while taking into account the Guidelines for the Alternative Care of Children annexed to General Assembly resolution 64/142 of 18 December 2009, undertake the necessary measures to protect the rights of children deprived of a family environment and address their needs with a focus on, inter alia:
49- توصي اللجنة بأن تقوم الدولة الطرف، مع مراعاة المبادئ التوجيهية للرعاية البديلة للأطفال المرفقة بقرار الجمعية العامة 64/142 المؤرخ 18 كانون الأول/ديسمبر 2009، باتخاذ تدابير اللازمة لحماية حقوق الأطفال المحرومين من بيئة أسرية وتلبية احتياجاتهم مع التركيز على جملة أمور منها:

Particular attention should be paid to protecting the rights of children deprived of their liberty, to raising the minimum age of criminal responsibility and to improving the quality and adequacy of alternative measures to imprisonment.
وينبغي إيلاء اهتمام خاص لحماية حقوق اﻷطفال المجردين من حريتهم، ورفع الحدّ اﻷدنى للسن المحدد للمساءلة الجنائية، وتحسين نوعية التدابير البديلة للسجن وكفايتها.
