6.5 In the days that followed, Djaafar Sahbi's brother, Youcef Sahbi, carried out a fruitless search at numerous police stations.

Although Djaafar Sahbi's family repeatedly contacted the competent authorities concerning his disappearance, the State party failed to conduct a thorough and effective investigation into the disappearance of the author's son, despite the fact that serious allegations of enforced disappearance were involved.
وعلى الرغم من أن أسرة جعفر صحبي أخطرت السلطات المختصة مراراً باختفائه، فإن الدولة الطرف لم تجر أي تحقيق معمّق ودقيق بشأن هذا الاختفاء رغم أن الأمر يتعلق بمزاعم خطيرة متصلة بالاختفاء القسري.

In the present case, the Committee notes that the State party has produced no evidence to indicate that it has fulfilled its obligation to protect Djaafar Sahbi's life.
وفي الحالة قيد النظر، تلاحظ اللجنة أن الدولة الطرف لم تقدم أية معلومات تفيد بأنها أوفت بالتزامها المتمثل في حماية حياة جعفر صحبي.

8.6 The Committee also takes note of the anguish and distress caused to the author by the disappearance of Djaafar Sahbi.
8-6 وتحيط اللجنة علماً أيضاً بما عانته صاحبة البلاغ من قلق وضيق جراء اختفاء جعفر صحبي.

The Committee concludes that Djaafar Sahbi's enforced disappearance nearly 18 years ago denied him the protection of the law and deprived him of his right to recognition as a person before the law, in violation of article 16 of the Covenant.
وتخلص اللجنة إلى أن اختفاء جعفر صحبي قسراً منذ ما يقرب من 18 عاماً حرمه من حماية القانون وحرمه من حقه في أن يُعترف له بشخصيته القانونية، وفي ذلك انتهاك للمادة 16 من العهد.
