The Chamber also concluded that Libya's national system was unable to secure the transfer of the accused into their custody or to carry out the proceedings in the case against Saif Al-Islam Gaddafi.
وخلصت الدائرة أيضا إلى أن النظام الوطني في ليبيا غير قادر على تأمين نقل المتهمين إلى أماكن احتجازهم، أو تنفيذ الإجراءات في القضية المرفوعة ضد السيد سيف الإسلام القذافي.

I should be grateful if this letter and the summary of the decision on the admissibility of the case against Saif Al-Islam Gaddafi before the Court could be transmitted to the members of the Security Council.

Saif Al-Islam Gaddafi (hereinafter Mr. Gaddafi) is a national of Libya.
3- سيف الإسلام القذافي (المشار إليه فيما يلي بالسيد القذافي) هو مواطن ليبي.

During the reporting period, the Secretary-General transmitted to the Security Council the decision of Pre-Trial Chamber I of 4 May 2012, inviting the Council to submit its observations on the application of the Government of Libya to the Court challenging the admissibility before the Court of the case against Saif Al-Islam Gaddafi.
وفي الفترة المشمولة بالتقرير، أحال الأمين العام إلى مجلس الأمن قرار الدائرة التمهيدية الأولى المؤرخ 4 أيار/مايو 2012 الذي تدعو فيه المجلس إلى تقديم ملاحظاته بشأن العريضة المقدمة من حكومة ليبيا إلى المحكمة تطعن فيها في جواز عرض الدعوى المقامة ضد سيف الإسلام القذافي على المحكمة.

The staff members were detained while conducting their official duties on a mission pursuant to a decision of Pre-Trial Chamber I of the Court, inter alia, for the purpose of holding a privileged meeting between Mr. Saif Al-Islam Gaddafi and his defence counsel.
لقد اعتُقل هؤلاء الموظفون أثناء أدائهم واجبهم الرسمي في إطار مهمة كانوا مكلفين بها عملا بقرار صادر عن الدائرة الأولى للإجراءات التمهيدية التابعة للمحكمة، لأغراض عدة بينها إجراء لقاء مشمول بالحصانة بين السيد سيف الإسلام القذافي ومحاميه.

- The basic purpose of the visit was to provide the ICC-appointed counsel for the defence with an opportunity of meeting with the accused, Saif Al-Islam Gaddafi, at his place of detention in the city of Zintan and to discuss the possibility of designating another counsel for the defence, one of his own choosing.

40. On 31 May 2013, Pre-Trial Chamber I rejected the admissibility challenge presented by Libya in the Saif Al-Islam Gaddafi case.
40 - وفي 31 أيار/مايو 2013، رفضت الدائرة التمهيدية الطعن المقدم من ليبيا بشأن مقبولية الدعوى في قضية سيف الإسلام القذافي.

The Prosecutor reported that the steady decline in the security situation in Libya had hampered the investigative activities of her office, and she reiterated the importance of the proper handling of the case of Abdullah al-Senussi and the legal obligation of the Government of Libya to cooperate with the Court and to surrender Saif Al-Islam Gaddafi to the Court.
وأفادت المدعية العامة أن التدهور المتواصل للحالة الأمنية في ليبيا قد أعاق إنجاز مكتبها لأنشطة التحقيق، وأكدت مجددا على أهمية التعامل المناسب مع قضية عبد الله السنوسي، وعلى أن حكومة ليبيا ملزمة قانونا بالتعاون مع المحكمة وتسليم سيف الإسلام القذافي إلى المحكمة.
