Measures taken on an emergency basis shall be temporary and shall be based on the best scientific evidence available.
وتكون التدابير التي تتخذ على أساس طارئ مؤقتة وتستند إلى أفضل اﻷدلة العلمية المتاحة.

(i) Use the best scientific evidence available and, if it is not sufficient, invest in emergency research while interim management measures are taken at the level required to avoid irreversible damage;
ُ١ُ الاستعانة بأفضل اﻷدلة العلمية المتاحة والاستثمار، إن لم يكن ذلك كافيا، في اﻷبحاث المتعلقة بالطوارئ على أن تتخذ في الوقت نفسه تدابير ادارية مؤقتة بالمستوى اللازم لتحاشي وقوع ضرر غير قابل لﻹزالة؛

(a) States shall act so as to obtain and share the best scientific evidence available in support of conservation and management decision-making.
)أ( تتصرف الدول بحيث تحصل على أفضل اﻷدلة العلمية المتاحة الداعمة لصنع القرار المتعلق بالحفظ واﻹدارة وتتقاسمها.

TACs are established on the basis of the best scientific evidence available of the size and structure of stocks as determined by the fisheries scientists employed by the Ministry.

More recently, General Assembly resolution 44/225 recognized, in its preamble, that " any regulatory measures ... should take account of the best scientific evidence available " .
وبعد ذلك، جاء قرار الجمعية العامة ٤٤/٢٢٥ الذي يسلم في ديباجته بأن " أية تدابير تنظيمية ... ينبغي لها أن تراعي أفضل اﻷدلة العلمية المتاحة " .

Measures taken in respect of the high seas shall take into account the rights, duties and interests of the coastal State under the Convention, shall be based on the best scientific evidence available and shall also take into account any conservation and management measures adopted and applied in respect of the same stocks in accordance with article 61 of the Convention by the coastal State in the area under national jurisdiction.
وتراعى في التدابير المتخذة فيما يتعلق بأعالي البحار حقوق وواجبات ومصالح الدولة الساحلية، بموجب الاتفاقية، وتستند تلك التدابير إلى أفضل اﻷدلة العلمية المتاحة وتراعى فيها أيضا أي تدابير للحفظ واﻹدارة تكون الدولة الساحلية قد اتخذتها وطبقتها فيما يتعلق باﻷرصدة نفسها وفقا للمادة ٦١ من الاتفاقية في المنطقة الخاضعة لولايتها الوطنية.

At its forty-ninth session, the General Assembly, in its resolution 49/118 of 19 December 1994, recognized that in relevant provisions of the United Nations Convention on the Law of the Sea 1/ States are called upon to take into consideration, when establishing conservation and management measures for target fisheries, the effects on associated or dependent species, taking into account the best scientific evidence available.
١ - في الدورة التاسعة واﻷربعين، أعربت الجمعية العامة، في القرار ٤٩/١١٨ المؤرخ ١٩ كانون اﻷول/ ديسمبر ١٩٩٤، عن إدراكها، ﻷن اﻷحكام ذات الصلة في اتفاقية اﻷمم المتحدة لقانون البحار)١( تطلب الى الدول أن تضع في اعتبارها، عند وضع تدابير الحفظ واﻹدارة لمصائد اﻷسماك المستهدفة، ما لهذه التدابير من آثار على اﻷنواع المرتبطة باﻷنواع المجتناة أو المعتمدة عليها، مع أخذ أفضل اﻷدلة العلمية المتاحة في الحسبان.
