8.4 The Committee also takes note of the anguish and distress caused by Mr. Sedhai's disappearance to the author and their two children, Anil and Anita Shedhai.

2.8 A week after Mr. Sedhai's arrest, the author was visited by a man in plain clothes who stated that he was from the District Police Office in Hanumandhoka, Kathmandu, and said that the author's husband would be released if she paid bail.
2-8 وبعد اعتقال السيد سيدهاي بأسبوع، زار صاحبة البلاغ رجل يرتدي ثياباً مدنيةً وقال إنه من مكتب شرطة المقاطعة في هانوماندوكا، كتمندو، وأبلغها بأنه سيتم الإفراج عن زوجها إذا دفعت كفالة.

5.4 The author further considers that the commission to investigate cases of disappearances and the Truth and Reconciliation Commission are not judicial bodies and that the bills providing for their establishment would not give them the power to impose appropriate punishment for the perpetrators of Mr. Sedhai's enforced disappearance.
5-4 وترى صاحبة البلاغ أيضاً أن اللجنة التي ستحقق في حالات الاختفاء ولجنة الحقيقة والمصالحة ليستا هيئتين قضائيتين وأن مشروعي القرارين اللذين سينصان على إنشائهما لن يمنحاهما صلاحيات فرض العقوبة المناسبة على المسؤولين عن الاختفاء القسري للسيد سيدهاي.

In the current case, although Mr. Sedhai's family repeatedly contacted the competent authorities regarding his disappearance, including judicial authorities such as the Police Headquarters, the District Police and the Supreme Court of Nepal, all their efforts led to nothing, and the State party failed to conduct a thorough and effective investigation into Mr. Sedhai's disappearance.

In view of Mr. Sedhai's incommunicado detention, the information provided by witnesses with regard to the detention conditions in Chhauni Barracks, and in the absence of information provided by the State party in that regard, the Committee finds a violation of article 10, paragraph 1, of the Covenant.
وبالنظر إلى احتجاز السيد سيدهاي في الحبس الانفرادي، وإلى المعلومات التي قدمها الشهود فيما يتعلق بأوضاع الاحتجاز في ثكنة شوني، وإلى عدم تقديم الدولة الطرف أية معلومات بهذا الشأن، تخلص اللجنة إلى حدوث انتهاك للفقرة 1 من المادة 10 من العهد().
