وتكفل الدول الأطراف عدم فصل أي طفل عن أبويه رغم أنفهما، إلا إذا قررت سلطات مختصة، تخضع لرقابة قضائية، وفقا للقوانين والإجراءات السارية، أن هذا الفصل ضروري لمصلحة الطفل العليا.

Counsel refers to the Convention on the Rights of the Child, which states that a child shall not be separated from his or her parents unless it is determined in accordance with applicable law and procedures that such separation is necessary for the best interest of the child.
ويشير المحامي إلى اتفاقية حقوق الطفل التي تنص على وجوب عدم فصل الطفل عن والديه ما لم يتقرر وفقاً للقوانين والإجراءات المعمول بها أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

Before resorting to separation, the State should provide support to the parents in assuming their parental responsibilities, and restore or enhance the family's capacity to take care of the child, unless separation is necessary to protect the child.
وقبل الإقدام على ذلك، ينبغي للدولة أن تدعم الوالدين لأداء مهامهم الأبوية، واستعادة قدرة الأسرة على رعاية الطفل أو الارتقاء بها، ما لم يكن الفصل ضرورياً لحماية الطفل.

The Working Group recalls that, pursuant to article 9, paragraph 1, of the Convention on the Rights of the Child, a child may be separated from his or her parents against their will, when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.
31- يذكّر الفريق العامل بأنه عملاً بأحكام الفقرة 1 من المادة 9 من اتفاقية حقوق الطفل لا يجوز فصل طفل عن والديه على كره منهما، إلا عندما تقرر السلطات المختصة، رهناً بإجراء إعادة نظر قضائية، وفقاً للقوانين والإجراءات المعمول بها، أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

3.3 The author maintains that according to article 9 of the Convention on the Rights of the Child, the State party must ensure that a child is not separated from his/her parents against their will, except when competent authorities, subject to judicial review, determine in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.
3-3 ويدعي صاحب البلاغ أنه، وفقاً لأحكام المادة 9 من اتفاقية حقوق الطفل، يتعين على الدولة الطرف أن تضمن عدم فصل الطفل عن والديه رغم إرادتهما، إلا عندما تقرر السلطات المختصة، رهناً بإجراء إعادة نظر قضائية، وفقاً للقانون والإجراءات المعمول بها، أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

Even when separation is necessary or unavoidable, the competent court, in this case the personal status court, makes the decision as to the child's place of residence in accordance with his or her interest.
وحتى عندما يكون الفصل ضرورياً أو حتمياً فإن المحكمة المختصة وهي محكمة الأحوال الشخصية تقرر محل إقامة الطفل وفقاً لمصلحته وقد ترسخ هذا المبدأ في المأخوذ من الأعراف السودانية قضائياً.

120. The measures of a legislative nature contained in chapter IV of the Personal Status of Muslims Act of 1991, which relates to custody, set forth the legal safeguards preventing separation of the child from his or her parents, except where such separation is necessary for the best interests of the child.
120- إن التدابير ذات الطابع التشريعي الواردة في الفصل الرابع من قانون الأحوال الشخصية للمسلمين لسنة 1991 والمتعلقة بالحضانة توضح الضمانات القانونية القضائية لمنع فصل الطفل عن والديه إلا إذا كان هذا الفصل ضرورياً لصون مصالح الطفل الفضلى.

(a) Provide families of children in need of care and protection with the necessary support and counselling in order to prevent child-parent separation, unless this separation is necessary in the best interests of the child;
