6. Article 2, paragraph 2, of the Optional Protocol provides for service in the armed forces before the age of 18, if agreed by the parents or official guardians of the child.

Article 21 of Act No. 67 of 1991, concerning service in the armed forces and security forces, spells out the conditions for enlistment by volunteers. The article provides that volunteers who have carried out national service will be accepted into the Armed Forces and security forces if they meet the following criteria:

However, it is concerned that Act No. 67 (1991) on service in the armed forces and the security forces, which establishes enlistment conditions for volunteers, does not contain an explicit provision setting a minimum age for voluntary recruitment.

36. The minimum length of service is 20 years or a period ending when the recruit reaches the age of 50. This is stipulated in article 105 of Act No. 67 of 1991, concerning service in the armed forces and the security forces. The entitlements stem from the 2010 Amendments to the Law on service in the armed forces of Bosnia and Herzegovina (adopted against the advice of the Ministry of Defence and the Ministry of Finance and Treasury of Bosnia and Herzegovina) allowing for early retirement of soldiers who had reached the statutory retirement age for their rank.

The mechanism to review the legality of methods of warfare and military doctrine is also regulated by the Article 34, paragraph 2 of the Law on service in the armed forces of the Republic of Croatia: " When conducting a combat assignment, a serviceman uses his/her firearms and other weapons pursuant to the regulations on combat activities. "
20- كما تنظم آليةَ استعراض شرعية أساليب الحرب والمذهب العسكري الفقرة 2 من المادة 34 من قانون الخدمة في القوات المسلحة لجمهورية كرواتيا على النحو التالي: " في حالات القتال، يستخدم العسكري أسلحته النارية وغيرها من الأسلحة وفقا للوائح الخاصة بأنشطة القتال " .

11. By the Law on service in the armed forces of the Republic of Croatia (Official Gazette No. 33/02), in the Article 32 paragraph 2 it is regulated that a member of the Armed Forces " is not obliged to carry out orders or commands of superiors if these orders or commands are contrary to common war practice and the law of armed conflicts " .

The Government also reserved the right not to apply the provisions of the Convention in so far as they are inconsistent with policies relating to recruitment into or service in the armed forces (in situations involving armed combat) and law enforcement forces " in situations involving violence or threat of violence. The United Nations then reimburses the troop-contributing State for compensation paid, provided that the State's claim for reimbursement has been duly certified by its auditor-general (or official of similar rank) as based on payment properly made pursuant to specific provisions of national legislation applicable to service in the armed forces of that State.

10. To give effect to the Act, a decision by the Ukrainian Cabinet of Ministers sets out: the procedure for the performance of alternative service; a list of the sectors of the economy, enterprises, organizations and institutions to which Ukrainian citizens may be assigned; and a list of active religious organizations (denominations) whose teachings do not permit the use of weapons or service in the armed forces.
٠١- ولتنفيذ هذا القانون، يحدد قرار صدر من مجلس الوزراء في أوكرانيا ما يلي: اﻹجراءات الواجبة لتأدية الخدمة البديلة؛ وقائمة القطاعات الاقتصادية والشركات والمنظمات والمؤسسات التي يجوز تعيين المواطنين اﻷوكرانيين فيها؛ وقائمة الهيئات )الطوائف( الدينية التي لا تجيز تعاليمها استخدام اﻷسلحة أو الخدمة في القوات المسلحة.

Conscience and Peace Tax International (CPTI) highlighted that under the " Law on Universal Military Service " , military service is made compulsory for all males aged 18 to 27, but with an exemption for, among others, " members of registered religious organisations whose religious teaching forbids the bearing of arms or service in the armed forces " .

The Bosnia and Herzegovina Ministry of Defence met with the Entity Pension Funds and the Entity Ministries for Veterans to discuss the Amended Law on service in the armed forces of Bosnia and Herzegovina.
