ثالثا - شروط خدمة قضاة المحكمة الجنائية الدولية ليوغوسلافيا السابقة والمحكمة الجنائية الدولية لرواندا

The conditions of service of the judges of the International Tribunal for the Former Yugoslavia are discussed in paragraphs 3 to 14 of document A/52/520.
وتناقش شروط خدمة قضاة المحكمة الدولية ليوغوســلافيا السابقة في الفقــرات من ٣ إلى ٤١ من الوثيقــة A/52/520.

The Advisory Committee hoped that the adoption of the conditions of service of the judges of the International Tribunal would put an end to any existing practice at the Tribunal which was not in conformity with Article 16 of the Statute of the International Court of Justice.
وقال إن اللجنة الاستشارية تأمل في أن يضع اعتماد شروط خدمة قضاة المحكمة الدولية حدا لممارسة قائمة في المحكمة لا تتفق مع المادة ١٦ من النظام اﻷساسي لمحكمة العدل الدولية.

4. Also requests the Secretary-General to submit a report on the conditions of service of the judges of the International Tribunal for Rwanda to the General Assembly at its fifty-second session, no later than 30 November 1997;
٤ - تطلب أيضا إلى اﻷمين العام أن يقدم تقريرا عن شروط خدمة قضاة المحكمة الدولية لرواندا إلى الجمعية العامة في دورتها الثانية والخمسين، في موعد لا يتجاوز ٣٠ تشرين الثاني/نوفمبر ١٩٩٧؛

2. Requests the Secretary-General to submit the report on the conditions of service of the judges of the International Tribunal for the Former Yugoslavia to the General Assembly at its fifty-second regular session, no later than 30 November 1997;
٢ - تطلب من اﻷمين العام أن يقدم التقرير المتعلق بشروط خدمة قضاة المحكمة الدولية ليوغوسلافيا السابقة إلى الجمعية العامة في دورتها العادية الثانية والخمسين، في موعد أقصاه ٣٠ تشرين الثاني/ نوفمبر ١٩٩٧؛

15. The Secretary-General fully appreciates the concerns expressed by the Advisory Committee and the General Assembly with regard to the terms and conditions of service of the judges of the Tribunal.
١٥ - ويعرب اﻷمين العام عن إدراكه التام للشواغل التي أعربت عنها اللجنة الاستشارية والجمعية العامة فيما يتعلق بأحكام وشروط خدمة قضاة المحكمة.

The Committee is of the opinion that, had it had an opportunity to review the administrative and budgetary aspects of the statute of the International Tribunal before it was adopted, it would have made recommendations to the General Assembly on conditions of service of the judges of the Tribunal taking into account, inter alia, the following:
وترى اللجنة أنه لو كانت قد أتيحت لها فرصة لاستعراض الجوانب اﻹدارية والمتعلقة بالميزانية من النظام اﻷساسي للمحكمة الدولية قبل اعتمادها، لكانت قد تقدمت بتوصيات الى الجمعية العامة بشأن شروط خدمة قضاة المحكمة مع مراعاة أمور منها ما يلي:

19. With regard to the conditions of service of the judges of the International Tribunal, her delegation questioned the relevance of decisions of the Security Council with regard to matters which, under the Charter, were within the competence of the General Assembly.
١٩ - وفيما يتعلق بشروط خدمة قضاة المحكمة الدولية، ذكرت أن وفدها يتساءل عن أهمية مقررات مجلس اﻷمن فيما يتعلق بالمسائل التي تقع في اختصاص الجمعيــــة العامة بموجب الميثاق.

33. As mentioned above, the General Assembly, in section VIII, paragraph 4, of its resolution 53/214, approved the recommendations of the Advisory Committee on, inter alia, the other conditions of service of the judges of the two Tribunals.
33 -كما ذُكر آنفا، فقد وافقت الجمعية العامة، في الفقرة 4 من الفرع الثامن من قرارها 53/214 على توصيات اللجنة الاستشارية بشأن جملة أمور منها شروط خدمة قضاة المحكمتين.

50. As indicated above, the General Assembly, in section VIII, paragraph 4, of its resolution 53/214, approved the recommendations of the Advisory Committee on Administrative and Budgetary Questions on, inter alia, the other conditions of service of the judges of the two Tribunals.
50 - وكما سبقت الإشارة إليه أعلاه، أقرت الجمعية العامة، في الفقرة 4 من الجزء الثامن من قرارها 53/214، توصيات اللجنة الاستشارية بشأن أمور منها شروط خدمة قضاة المحكمتين الدوليتين.

63. In accordance with their respective statutes, the terms and conditions of service of the judges of the International Tribunal for the Former Yugoslavia are those of the judges of the International Court of Justice, while the terms and conditions of service of the judges of the International Tribunal for Rwanda are those of judges of the International Tribunal for the Former Yugoslavia.
٣٦ - وشروط خدمة قضاة المحكمة الدولية ليوغوسلافيا السابقة هي شروط خدمة قضاة محكمة العدل الدولية، وفقا للنظام اﻷساسي لكل منهما، وتتفق شروط خدمة قضاة المحكمة الدولية لرواندا مع شروط خدمة المحكمة الدولية ليوغوسلافيا السابقة.

2. Requests the Secretary-General to submit the report on the conditions of service of the judges of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 to the General Assembly at its fifty-second session, no later than 30 November 1997;
٢ - تطلب الى اﻷمين العام أن يقدم التقرير المتعلق بشروط خدمة قضاة المحكمة الدولية لمحاكمة اﻷشخاص المسؤولين عن الانتهاكات الجسيمة للقانون اﻹنساني الدولي التي ارتكبت في إقليم يوغوسلافيا السابقة منذ عام ١٩٩١، إلى الجمعية العامة في دورتها الثانية والخمسين، في موعد أقصاه ٣٠ تشرين الثاني/ نوفمبر ١٩٩٧؛
