يقدَّم هذا التقرير استجابة لقرار الجمعية العامة 57/306 المؤرخ 15 نيسان/ أبريل 2003، الذي طلبت فيه الجمعية إلى الأمين العام الاحتفاظ ببيانات عن التحقيقات في الاستغلال الجنسي وما يتصل به من جرائم.

It is the obligation of States parties to enact and enforce laws to prohibit all forms of sexual exploitation and related trafficking; to collaborate with other States parties to eliminate intercountry trafficking; and to provide appropriate health and counselling services to adolescents who have been sexually exploited, making sure that they are treated as victims and not as offenders.
ومن واجب الدول الأطراف أن تعمل على سَنِّ وإنفاذ قوانين لحظر كافة أشكال الاستغلال الجنسي وما يرتبط به من اتجار؛ وأن تتعاون مع غيرها من الدول الأطراف للقضاء على الاتجار بين البلدان؛ وأن توفِّر الخدمات الصحية وخدمات تقديم المشورة الملائمة للمراهقين الذين وقع استغلالهم جنسياً، مع كفالة معاملتهم معاملة الضحايا لا المجرمين.

9. Recognizes the shared responsibility, within their respective competencies, of United Nations organizations and agencies and troop-contributing countries to ensure that all personnel are held accountable for sexual exploitation and related offences committed while serving in humanitarian and peacekeeping operations;

The scope ratione materiae of a future convention should not be limited to sexual exploitation and related offences, but should extend to crimes of an economic nature, such as illicit trafficking in drugs and precious materials.
ولا يجب أن يقتصر نطاق الاختصاص الموضوعي في أية اتفاقية في المستقبل على الاستغلال الجنسي وما يتصل بذلك من جنايات، وإنما يجب أن يتسع ليشمل الجنايات ذات الطبيعة الاقتصادية مثل الاتجار غير المشروع بالمخدرات والمواد النفيسة.

Similarly, pursuant to General Assembly resolution 57/306, the Secretary-General maintains data on investigations into sexual exploitation and related offences by humanitarian and peacekeeping personnel, and all relevant actions taken thereon, and reports accordingly to the General Assembly on an annual basis.
كما أنه وعملا بقرار الجمعية العامة 57/306، يحتفظ الأمين العام ببيانات عن التحقيقات في الاستغلال الجنسي وما يتصل به من جرائم ارتكبها أفراد عاملون في مجال المساعدة الإنسانية وحفظ السلام، وعن جميع الإجراءات ذات الصلة التي اتخذت بشأن ذلك، ويقدم تقريرا بهذا الشأن إلى الجمعية العامة كل سنة.

However, the Committee is deeply concerned by the wide occurrence of sexual exploitation and related issues, as also noted in the report of the Special Rapporteur on the sale of children, child prostitution, and child pornography following his mission to Brazil in 2003 (E/CN.4/2004/9/Add.2).
إلا أنه يساور اللجنة بالغ القلق إزاء تفشي ظاهرة الاستغلال الجنسي وما يتصل بذلك من مسائل، على نحو أشير إليه أيضا في تقرير المقرر الخاص المعني ببيع الأطفال واستغلالهم في البغاء وفي المواد الخليعة، الصادر عقب زيارته البرازيل في عام 2003 (E/CN.4/2004/9/Add.2).
