Paragraph 3 gives anyone arrested or detained on a criminal charge the right to be brought promptly before a judge and states that it shall not be the general rule that persons awaiting trial shall be detained in custody.
وتعطي الفقرة ٣ ﻷي فرد يتم القبض عليه أو احتجازه بتهمة جنائية الحق في المثول على وجــه السرعة أمام أحد القضاة وتقول إنه لا يجوز أن يكون احتجاز اﻷشخاص الذين ينتظرون المحاكمة هو القاعدة العامة.

This article goes on to state that it shall not be the general rule that persons awaiting trial shall be detained in custody, and that anyone who has been the victim of unlawful arrest or detention shall have an enforceable right to compensation.
وتمضي هذه المادة فتقول إنه لا يجوز أن يكون احتجاز اﻷشخاص الذين ينتظرون المحاكمة هو القاعدة العامة، وإن لكل شخص كان ضحية توقيف أو اعتقال غير قانوني حقاً في الحصول على تعويض.

Article 76 of the Fourth Geneva Convention is unequivocal: " Protected persons accused of offenses shall be detained in the occupied country, and if convicted they shall serve their sentences therein. "
فالمادة 76 من اتفاقية جنيف الرابعة تنص على نحو لا لبس فيه على ما يلي: ' ' يحتجز الأشخاص المحميون المتهمون في البلد المحتل، ويقضون فيه عقوبتهم إذا أدينوا``.

Protected persons accused of offences shall be detained in the occupied country, and if convicted they shall serve their sentences therein.
يحتجز الأشخاص المحميون المتهمون في البلد المحتل، ويقضون فيه عقوبتهم إذا أدينوا.

Similarly, section 15 of the Civil Liberties Act provides that no person shall be detained without being informed as to the reason for detention.
وبالمثل ينص الباب ١٥ من قانون الحريات المدنية على أنه لا يجوز حبس أي شخص بدون ابلاغه بسبب الحبس.

121. The Constitution provides that no person shall be detained for more than 48 hours without the authority of a Magistrate.

These articles provide that persons shall only be deprived of their liberty in cases provided for by law, shall be detained only for the duration decided by the authorities, shall not be subjected to ill-treatment, and shall have the right to seek the assistance of a lawyer during the investigation phase and at trial.
وتنص هاتان المادتان على أنّه يتعين ألاَّ يُحرم شخصٌ من حقوقه إلاّ في الحالات التي ينص عليها القانون وألاَّ يٌحتجز إلاّ لمدة تحدِّدها السلطات وألاّ تُساء معاملته ويتعيَّن أن يحظى بالحق في السعي إلى الحصول على مساعدة محام خلال مرحلة التحقيق وأثناء المحاكمة.

ولا يجوز أن يكون احتجاز الأشخاص الذين ينتظرون المحاكمة هو القاعدة العامة، ولكن من الجائز تعليق الإفراج عنهم على ضمانات لكفالة حضورهم المحاكمة في أية مرحلة أخرى من مراحل الإجراءات القضائية، ولكفالة تنفيذ الحكم عند الاقتضاء.

Thus it " shall not be the general rule that persons awaiting trial shall be detained in custody " , but the exception calls for a restrictive interpretation of the circumstances in which a person can be placed and maintained in pretrial detention;
وعليه، " لا يجوز أن يكون احتجاز الأشخاص الذين ينتظرون المحاكمة هو القاعدة العامة " وإنما الاستثناء، الأمر الذي يستلزم تفسير شروط الحبس والإبقاء في الحبس قبل المحاكمة تفسيراً ضيقاً؛

وحسب المصدر، تقضي تلك المعايير بألاَّ يُحرم شخصٌ من حقوقه إلاّ في الحالات التي ينص عليها القانون، وألاَّ يٌحتجز إلاّ لمدة تحدِّدها السلطات، وألاّ تُساء معاملته، وأن يكون له حق السعي إلى الحصول على مساعدة محامٍ خلال مرحلة التحقيق وأثناء المحاكمة.
