Article 32 states that " States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free and informed consent prior to the approval of any project affecting their lands or territories and other resources, particularly in connection with the development, utilization or exploitation of mineral, water or other resources " .
فالمادة 32 تنص على ما يلي: " على الدول أن تتشاور وتتعاون بحسن نية مع الشعوب الأصلية المعنية من خلال المؤسسات التي تمثلها للحصول على موافقتها الحرة والمستنيرة قبل إقرار أي مشروع يؤثر في أراضيها أو أقاليمها ومواردها الأخرى، ولا سيما فيما يتعلق بتنمية أو استخدام أو استغلال الموارد المعدنية أو المائية أو الموارد الأخرى " .

22. One of the basic articles in the United Nations Declaration on the Rights of Indigenous Peoples stipulates that States " shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free, prior and informed consent before adopting and implementing legislative or administrative measures that may affect them " (art. 19).
22- تنص إحدى المواد الأساسية في إعلان الأمم المتحدة بشأن حقوق الشعوب الأصلية على أنه على الدول " أن تتشاور وتتعاون بحسن نية مع الشعوب الأصلية المعنية من خلال المؤسسات التي تمثلها للحصول على موافقتها الحرة والمسبقة والمستنيرة وذلك قبل اعتماد وتنفيذ التدابير التشريعية أو الإدارية التي يمكن أن تمسها " (المادة 19).

Paragraph 2 provides that " States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free and informed consent prior to the approval of any project affecting their lands or territories and other resources, particularly in connection with the development, utilization or exploitation of mineral, water or other resources. "
فالفقرة 2 من تلك المادة تنص على أنه " على الدول أن تتشاور وتتعاون بحسن نية مع الشعوب الأصلية المعنية من خلال المؤسسات التي تمثلها للحصول على موافقتها الحرة والمستنيرة قبل إقرار أي مشروع يؤثر في أراضيها أو أقاليمها ومواردها الأخرى، ولا سيما فيما يتعلق بتنمية أو استخدام أو استغلال الموارد المعدنية أو المائية أو الموارد الأخرى " .

58. In affirming the general rule of consent for extractive activities within indigenous territories, the United Nations Declaration on the Rights of Indigenous Peoples emphasizes that, in order to obtain consent, " States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representatives " (art. 32, para. 2).
58- إن إعلان الأمم المتحدة بشأن حقوق الشعوب الأصلية إذ يؤكد القاعدة العامة التي تقيّد القيام بأنشطة استخراجية داخل أقاليم الشعوب الأصلية بالحصول على موافقتها، فهو يشدّد على أن حصول الدول على الموافقة يتطلب منها " أن تتشاور وتتعاون بحسن نية مع الشعوب الأصلية المعنية من خلال المؤسسات التي تمثلها " (الفقرة 2 من المادة 32).
