The Working Group notes that the assertions received from the source and the Government are in most respects contradictory.

31. Both the source and the Government recognize that during the trial complicated expert evidence was presented and assessed by the Court.
31- ويقرّ المصدر والحكومة كلاهما بأن خبراء قدموا أدلة معقدة خلال المحاكمة وقامت المحكمة بتقييم تلك الأدلة.

While both the source and the Government have quoted some passages from these decisions, the Working Group is not in a position to make a definite assessment of the reasoning behind the dismissal by the Court of the defendants' applications for bail.

27. After examining the communications from the source and the Government's response, the Working Group finds that:

Since the allegations of the source and the Government are completely contradictory in this regard, and the Russian Federation, under whose jurisdiction the alleged abduction was carried out, does not take part in the present proceeding, the Working Group is not in a position to take a stand in the matter of this allegation of the source.

It is common for the Working Group to facilitate subsequent exchanges of information between the source and the Government until the case is clarified (see paragraph 11).

5- وقرر الفريق العامل في رأيه رقم 24/1994، إبقاء القضية قيد النظر إلى أين يتلقى مزيدا من المعلومات من المصدر والحكومة على السواء.

6. According to the complaint and the new facts provided by the source and the Government, army General José Francisco Gallardo Rodríguez was arrested on 9 November 1993 and charged with offences allegedly committed in 1989.
6- وتفيد الشكوى والعناصر الجديدة المقدمة من المصدر والحكومة أن العميد بالجيش خوسيه فرانسيسكو غَلياردو رودريغِس قد اعتقل في 9 تشرين الثاني/نوفمبر 1993، واتهم بجرائم يُدَّعى أنه ارتكبها في عام 1989.

12. From the contradictory statements of the source and the Government, it seems to the Working Group that the detention of these leading political figures is related to the ongoing political debate about the way the country is governed by the President.
12- ويبدو للفريق العامل من أقوال المصدر والحكومة المتناقضة، أن اعتقال تلك الشخصيات السياسية القيادية هذه له صلة بالنقاش السياسي الدائر حول الطريقة التي يحكم بها الرئيس البلد.

The presentation of the events by the source and the Government coincide in that the bankruptcy of the plant and its ensuing difficulty in paying wages to its employees caused tension in the locality; the versions of the source and the Government are completely contradictory, however, as to the peaceful or violent nature of Mr. Yao's acts.
ويتفق عرض كل من المصدر والحكومة للوقائع في أن إفلاس المصنع وما ترتب عليه من صعوبة في دفع أجور العمال قد سبب توتر الوضع في المنطقة. بيد أن الروايتين على طرفي نقيض تماماً إذا ما تعلق الأمر بتحديد الطابع السلمي أو العنيف الذي اتسمت به أفعال السيد ياو.

The Working Group wishes to point out that according to the information provided by both the source and the Government it is beyond any doubt that they are forcibly held under conditions that are equivalent to deprivation of liberty, regardless of the fact that the terms of the open detention include leave from the military base every third weekend.

21. The Working Group considers that to render an opinion it must receive additional information from both the source and the Government on the following points:

With regard to the alleged violations of the right to a fair trial, the Working Group notes that the assertions received from the source and the Government are in most respects contradictory.
