21. The Committee recommends that the State party amend its criminal legislation to include an explicit prohibition of the recruitment or use in hostilities of children under the age of 18 in the State armed Forces and non-State armed groups and ensure that penalties are commensurate with the gravity of the crime.

It is also concerned at the lack of detailed information on the specific measures in place to ensure the release, recovery and reintegration of children associated with State armed Forces, as well as of children, including girls, associated with pro-Government armed groups and tribal militias and non-State armed groups, such as Al-Houthi and Ansar al-Sharia.

While welcoming that several national laws establish the age of voluntary recruitment into the Armed Forces as 18 years, including in the National Police Force and the Local Defence Forces, the Committee is concerned about the absence of explicit criminalization in the domestic legislation of the recruitment and use in hostilities of children by the State armed Forces and by the non-State armed groups.
13- ترحب اللجنة بأن عدداً من القوانين الوطنية يجعل سن التجنيد الطوعي في القوات المسلحة، بما فيها قوة الشرطة الوطنية وقوات الدفاع المحلية 18 سنة، ولكن القلق يساورها لأن التشريعات المحلية لا تجرّم صراحة تجنيد القوات المسلحة الحكومية والمجموعات المسلحة غير الحكومية للأطفال واستخدامهم في الأعمال العدائية.

The Human Rights Committee has considered the forced recruitment of minors into militias and State armed forces as a violation of article 8 of the International Covenant on Civil and Political Rights and requested the State party concerned to provide information on the steps taken to eliminate the forced recruitment of minors into the armed forces and rehabilitate and protect the victims (CCPR/C/COD/CO/3, para. 18).
39- ورأت اللجنة المعنية بحقوق الإنسان أن التجنيد القسري للقصّر في المليشيات والقوات المسلحة الحكومية يمثل انتهاكاً للمادة 8 من العهد الدولي الخاص بالحقوق المدنية والسياسية، وطلبت إلى الدولة الطرف المعنية تقديم معلومات عن الخطوات المتخذة لوضع حد للتجنيد القسري للقصر في صفوف القوات المسلحة، ولإعادة تأهيل الضحايا وحمايتهم (CCPR/C/COD/CO/3، الفقرة 18).
