• الدولة الطرف التي

(i) Where only one has been nominated by the State Party of which he or she is a national, that national shall serve as the member of the Subcommittee;
`١` إذا كان أحدهما فقط من مواطني الدولة الطرف التي قامت بترشيحه يصبح هذا المواطن عضوا في اللجنة الفرعية؛

(ii) Where both nationals have been nominated by the State Party of which they are nationals, a separate vote by secret ballot shall be held to determine which national shall be the member;
`٢` إذا كان كلاهما من مواطني الدولة الطرف التي قامت بترشيحهما يجري تصويت منفصل بالاقتراع السري لتحديد أيهما يصبح عضواً؛

(iii) Where neither national has been nominated by the State Party of which he or she is a national, a separate vote by secret ballot shall be held to determine which national shall be the member.
`٣` إذا لم يكن أي منهما من مواطني الدولة الطرف التي رشحتهما، يجري تصويت منفصل بالاقتراع السري لتحديد أيهما يصبح عضواً.

' ٣ ' إذا لم يكن أي من المرشﱠحين من مواطني الدولة الطرف التي رشحتهما، يجري انتخاب منفصل بالاقتراع السري لتحديد أيهما يصبح عضواً.

The provisions of paragraphs 1 and 2 of this article are not applicable as between a representative and the authorities of the State Party of which he or she is a national or of the State Party or intergovernmental organization of which he or she has been a representative.
4 - 3 لا تسري أحكام الفقرتين 1 و 2 من هذه المادة على ممثل ما تجاه سلطات الدولة الطرف التي يكون من رعاياها أو ممثلا لها. الدولة الطرف أو المنظمة الحكومية الدولية التي كان ممثلا لها.

4. The provisions of paragraphs 1 and 2 of this article are not applicable as between a representative and the authorities of the State Party of which he or she is a national or of which he or she has been a representative.
4 - لا تسري أحكام الفقرتين 1 و 2 من هذه المادة على ممثل ما تجاه سلطات الدولة الطرف التي يكون من رعاياها أو ممثلا لها().

(c) Enforcement of the Committee's rules of procedure which prohibits members from being present during the consideration of the report of the State Party of which they are nationals;
(ج) تطبيق النظام الداخلي للجنة الذي يمنع الأعضاء من الحضور خلال النظر في تقرير الدولة الطرف التي هم من مواطنيها؛

1. The State Party of which a victim of trafficking in persons is a national or in which the person had the right of permanent residence at the time of entry into the territory of the receiving State Party shall facilitate and accept, with due regard for the safety of that person, the return of that person without undue or unreasonable delay.
1- يتعين على الدولة الطرف التي يكون ضحية الاتجار بالأشخاص من مواطنيها أو التي كان يتمتع بحق الاقامة الدائمة فيها وقت دخوله الى اقليم الدولة الطرف المستقبلة، أن تيسر وتقبل عودة ذلك الشخص دون ابطاء لا مسوّغ له أو غير معقول، مع ايلاء الاعتبار الواجب لسلامة ذلك الشخص.

The Human Rights Committee finds that the State party violated articles 14 and 17 of the Covenant in its extensive and unreasonable delays in the judicial appeals from the administrative refusal to grant either a residence permit, work permit or citizenship to the author's husband, so that they might reside together within the territory of the State Party of which she is a citizen.
خلصت اللجنة المعنية بحقوق الإنسان إلى استنتاج يفيد بأن الدولة الطرف انتهكت المادتين 14 و17 من العهد في لجوئها إلى حالات تأخير ممتدة وغير معقولة في الطعون القضائية ضدّ الرفض الإداري الذي شمل كلاً من منح ترخيص إقامة أو ترخيص عمل أو جنسية لزوج صاحبة البلاغ، حتى يمكنهما الإقامة معاً داخل إقليم الدولة الطرف التي هي مواطنة فيه.
