وأضافت الحكومة أنه " من حيث الإجراء، يجدر التأكيد مجدداً على أن القرار الذي يؤكد أسرار الدولة يجب أن يكون صريحاً، وألا يتخذه سوى رئيس مجلس الوزراء، وذلك في ضوء الشروط الأساسية الصارمة التي يحددها القانون، ولا يجوز أن يتخذ هذا النوع من القرارات لا الشخص المتهم ولا الشهود " .

In this connection, the High Commissioner also emphasized the challenges to human rights posed by the increased reliance by States on intelligence, including the abuse of the State secrecy doctrine in the context of legal proceedings, the use in legal proceedings of evidence obtained by illegal means, whether at home or abroad, and the use of secret evidence.

The challenges to human rights posed by the increased reliance by States on intelligence, including the abuse of the State secrecy doctrine in the context of legal proceedings, the use in legal proceedings of evidence obtained by illegal means, whether at home or abroad, and the use of secret evidence, all require greater attention by the international community.
إن التحديات المتعلقة بحقوق الإنسان التي يطرحها تزايد ركون الدول إلى المعلومات الاستخباراتية، بما في ذلك إساءة تطبيق مبدأ أسرار الدولة في سياق الإجراءات القانونية، واستخدام أدلة انتُزعت بأساليب غير قانونية في الإجراءات القانونية، سواء في الداخل أو الخارج، واستعمال الأدلة السرية، تتطلب كلها المزيد من اهتمام المجتمع الدولي.
