It is the policy of the Government of the State of Bahrain that security cases are dealt with under criminal law, and not under administrative procedures of the 1974 State Security Law.
وإن السياسة التي تتبعها حكومة دولة البحرين تقضي بتناول القضايا اﻷمنية في إطار القانون الجنائي وليس في إطار الاجراءات اﻹدارية المنصوص عليها في قانون أمن الدولة الصادر في عام ٤٧٩١.

The Working Group recalls its conclusion that the application of the State Security Law is liable to cause grave violations of the right to a fair trial, guaranteed by articles 9 and 10 of the Universal Declaration of Human Rights.

The application of the State Security Law is also in contravention of principles 10, 11, 12, 13, 15, 16, 17, 18, 19 and in particular principle 33 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
كما أن تطبيق قانون أمن الدولة مخالف للمبادئ ٠١ و١١ و٢١ و٣١ و٥١ و٦١ و٧١ و٨١ و٩١ وبوجه خاص المبدأ ٣٣ من مجموعة المبادئ المتعلقة بحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن.

In particular, the Government has not reacted to the allegation that the above-mentioned individuals may, pursuant to the State Security Law of 1974, be detained for up to three years without charges or trial.
وعلى وجه الخصوص، لم ترد الحكومة على الادعاء القائل بجواز احتجاز اﻷفراد المذكورين أعلاه، عملاً بقانون أمن الدولة لعام ٤٧٩١، لفترة تصل إلى ثلاث سنوات دون اتهام أو محاكمة.

9. It appears from the above, since the Government does not challenge this, that the eight persons admittedly detained, are being held under the 1974 State Security Law.
٩- ويبدو مما تقدم، وهو ما لا تعترض عليه الحكومة، أن اﻷشخاص الثمانية الذين اعترف باحتجازهم، مسجونون بوجب قانون أمن الدولة الصادر في عام ٤٧٩١.

It was further alleged that the aforementioned State Security Law had not been approved by the National Assembly, as required by the Constitution, and that, as a result, the very legality of that law was in question.
وادُعي كذلك أن قانون أمن الدولة المذكور آنفاً لم توافق عليه الجمعية الوطنية، على النحو الذي يتطلبه الدستور، وأن الشك يكتنف نفس مشروعية هذا القانون نتيجة لذلك.

9. The Government firmly rejected the allegation by the source that the State Security Law was unconstitutional.
٩- وترفض الحكومة رفضاً جازماً الادعاء المقدم من المصدر ومفاده أن قانون أمن الدولة غير دستوري.

In 2005, CAT expressed its concern at certain provisions of the bill which would reduce safeguards against torture and could re-establish conditions that characterized past abuses under the State Security Law.

It was believed that all the above-mentioned persons were detained under article 1 of the 1974 State Security Law, which reportedly allows the authorities to detain individuals under administrative detention without charge or trial for up to three years.

10. It transpires from the facts as submitted, which as such are not contested by the Government, that the two brothers, Ali and Mahdi, are detained pursuant to the State Security Law of 1974.

The Government, while referring to the 1976 Criminal Procedure Code, some provisions of which were allegedly violated by those detained by committing serious common—law crimes, failed to indicate whether in the case of those detainees the authorities applied the State Security Law or the Criminal Procedure Code.

In respect of the application of the State Security Law of 1974, the Working Group refers to its previous Opinion No. 1995/35, especially paragraphs 5, 9 and 12 to 17 thereof, in which the Group concluded that the application of the Law may result in serious violations of the right to a fair trial guaranteed by articles 9 and 10 of the Universal Declaration.

According to this information, the State Security Legislation is composed of the Administrative Emergency Measures (1974 State Security Law) as well as ordinary criminal law (1976 Penal Code).
وتفيد هذه المعلومة بأن تشريع أمن الدولة يتألف من تدابير إدارية لحالات الطوارئ )قانون أمن الدولة الصادر في عام ٤٧٩١(، فضلاً عن القانون الجنائي العادي )قانون العقوبات لعام ٦٧٩١(.

5. According to the communication, the 33 persons concerned were minors who had been detained between July and November 1996 under the 1974 State Security Law, article 1, which reportedly provides for the administrative detention without charge or trial for up to three years.
٥- ويفيد البلاغ بأن ٣٣ من اﻷشخاص المعنيين كانوا من القاصرين واحتجزوا في الفترة بين تموز/يوليه وتشرين الثاني/نوفمبر ٦٩٩١ عملاً بالمادة ١ من قانون أمن الدولة الصادر في عام ٤٧٩١، التي تنص كما ذكر على الاحتجاز اﻹداري دون إدانة أو محاكمة لفترة قد تصل إلى ثلاثة أعوام.

8. The Working Group notes with regret that the Government did not react to the allegation concerning the 1974 State Security Law under which the persons concerned are reportedly detained.
٨- ويلاحظ الفريق العامل بأسف أن الحكومة لم ترد على الادعاء المتعلق بقانون أمن الدولة الصادر في عام ٤٧٩١، والذي احتجز بموجبه اﻷشخاص المعنيون على ما يُزعم.
