12. The Committee recommends that States parties review legislation dealing with children deprived of a family environment to ensure that placement decisions are subject to periodic judicial review, including at the request of children themselves.
12- توصي اللجنة الدول الأطراف باستعراض التشريعات التي تتعلق بالأطفال المحرومين من بيئة أسرية وذلك بغية ضمان إخضاع قرارات الإيداع لعمليات استعراض قضائي دورية، بما في ذلك الاستعراض بطلب من الأطفال أنفسهم.

The Committee strongly recommends that States parties review and, where necessary, reform their legislation and practice to increase the minimum age for marriage with and without parental consent to 18 years, for both girls and boys.
وتوصي اللجنة بشدَّة الدول الأطراف باستعراض التشريعات والممارسات، وإصلاحها عند الضرورة، بغية رفع السن الدنيا للزواج بموافقة الوالدين أو بدون موافقتهما، إلى الثامنة عشرة، بالنسبة للفتيات والفتيان على السواء.

(a) States parties review their national legislation and ensure that it is in conformity with the Convention;
(أ) قيام الدول الأطراف باستعراض تشريعاتها الوطنية وضمان مسايرتها لأحكام الاتفاقية؛

(b) States parties review any declarations made at the time of signature or ratification or accession, and ensure that they are in accordance with the Convention;

The Committee strongly recommends that States parties review and, where necessary, reform their legislation and practice to increase the minimum age for marriage with and without parental consent to 18 years, for both girls and boys. The Committee on the Elimination of Discrimination against Women has made a similar recommendation (general comment No. 21 of 1994).
وتوصي اللجنة بشدَّة الدول الأطراف باستعراض التشريعات والممارسات، وإصلاحها عند الضرورة، بغية رفع السن الدنيا للزواج بموافقة أو بدون موافقة الوالدين، إلى الثامنة عشرة، بالنسبة للفتيات والفتيان على السواء. (التعليق العـام رقم 21 لعام 1994).

10. The Committee recommends that States parties review emergency and/or national security legislation to ensure that it provides appropriate safeguards to protect the rights of children and prevent violence against them, and that it is not used inappropriately to target children (for example, as threats to public order or in response to children living or working on the streets).
10- وتوصي اللجنة الدول الأطراف باستعراض التشريعات المتعلقة بحالات الطوارئ و/أو الأمن الوطني بغرض ضمان أن تنص هذه التشريعات على ضمانات مناسبة لحماية حقوق الطفل ومنع العنف ضده، وضمان عدم استخدامه على نحو غير مناسب وسيلة لاستهداف الأطفال (مثل الخطر على النظام العام أو رداً على الأطفال الذين يعيشون أو يعملون في الشوارع).

7. The Committee recommends that States parties review all provisions of criminal legislation, including on criminal procedure, dealing with children under 18 (including any special legislation applying to armed forces) so as to ensure that it reflects appropriately the provisions of the Convention on the Right of the Child (arts. 37 and 40).

8. The Committee recommends that States parties review all relevant legislation to ensure that all forms of violence against children, however light, are prohibited, including the use of torture, or cruel, inhuman or degrading treatment (such as flogging, corporal punishment or other violent measures), for punishment or disciplining within the child justice system, or in any other context.
8- وتوصي اللجنة الدول الأطراف باستعراض جميع التشريعات ذات الصلة كي تضمن منع جميع أشكال العنف ضد الأطفال مهما كانت خفيفة، بما في ذلك استخدام التعذيب أو المعاملة القاسية أو اللاإنسانية أو المهينة (مثل الفلق والمعاقبة البدنية أو غير ذلك من التدابير العنيفة)، لأغراض العقاب أو التأديب في نظام قضاء الأحداث أو في أي سياق آخر.

The Committee recommends that States parties review all relevant legislation to ensure that children under 18, who are in need of protection are not considered as offenders (including legislation dealing with abandonment, vagrancy, prostitution, migrant status, " truancy " , runaways, etc.) but are dealt with under child protection mechanisms.
9- وتوصي اللجنة الدول الأطراف باستعراض جميع التشريعات ذات الصلة كي تضمن ألا يعتبر الأطفال الذين هم دون سن الثامنة عشرة وبحاجة إلى الحماية مجرمين (بما في ذلك تشريع يتناول الهجر، والتسييب، والبغاء، واللجوء، " والتغيب عن المدرسة " ، والهروب، وما إلى ذلك) وضمان التعامل مع هؤلاء الضحايا بموجب آليات حماية الطفل.
