يشدد على أن القانون الدولي يتضمن أحكاماً تحظر الهجمات الموجهة عن علم وبشكل مقصود ضد الأفراد العاملين في بعثة لتقديم المساعدة الإنسانية أو لحفظ السلام يتم الاضطلاع بها وفقا لميثاق الأمم المتحدة، والتي تشكل، في حالات النـزاعات المسلحة، جرائم حرب، ويشير إلى ضرورة أن تضع الدول حدا للإفلات من العقاب على تلك الأفعال الإجرامية.

وإذ يشدد على أن القانون الدولي يتضمن أحكاما تحظر الهجمات الموجهة عن علم وبشكل مقصود ضد الأفراد العاملين في بعثة لتقديم المساعدة الإنسانية أو لحفظ السلام يتم الاضطلاع بها وفقا لميثاق الأمم المتحدة، والتي تشكل، في حالات الصراعات المسلحة، جرائم حرب، وإذ يشير إلى ضرورة أن تضع الدول حدا للإفلات من العقاب على تلك الأفعال الإجرامية.

30- وشدد مجلس الأمن في قراره 1325(2000)، على مسؤولية الدول عن وضع حد للإفلات من العقاب وعن مقاضاة المسؤولين عن جرائم الحرب المتعلقة بالعنف الجنسي الذي تتعرض له النساء وغيره من أشكال العنف.

1. Emphasizes the importance of combating impunity to the prevention of violations of human rights and international humanitarian law and urges States to end impunity for such crimes by bringing the perpetrators, including accomplices, to justice in accordance with international law;
1- تؤكد أهمية مكافحة الإفلات من العقاب في منع حدوث انتهاكات لقانون حقوق الإنسان وللقانون الإنساني الدولي، وتحث الدول على وضع حد للإفلات من العقاب على مثل هذه الجرائم وذلك بمقاضاة الجناة وشركائهم وفقاً للقانون الدولي؛

Emphasizes the importance of combating impunity to the prevention of violations of human rights and international humanitarian law and urges States to end impunity for violations that constitute crimes by bringing the perpetrators, including accomplices, to justice in accordance with international law, in particular standards of justice, fairness and due process of law;
1- تؤكد على أهمية مكافحة الإفلات من العقاب في منع حدوث انتهاكات لقانون حقوق الإنسان وللقانون الإنساني الدولي، وتحث الدول على وضع حد للإفلات من العقاب على الانتهاكات التي تشكل جرائم وذلك بمقاضاة مرتكبيها وشركائهم وفقاً للقانون الدولي، ولا سيما لمعايير العدالة والإنصاف والأصول القانونية الواجبة؛

In order to make this paragraph acceptable for us, we had suggested replacing this clause with the following words from the fifth preambular paragraph of Security Council resolution 1502 (2003): " ... the need for States to end impunity for such criminal acts " . However, that amendment was rejected.
ولكي نجعل هذه الفقرة مقبولة لنا، اقترحنا الاستعاضة عن هذا النص بالعبارة التالية من الفقرة الخامسة من ديباجة قرار مجلس الأمن 1502 ( 2003 ): " ... ضرورة أن تضع الدول حداً للإفلات من العقاب على تلك الأفعال الإجرامية " ولكن ذلك التعديل قوبل بالرفض.

`25.
