Since an organ includes any person or entity which has that status in accordance with the internal law of the State, a term " State official " , for purposes of State responsibility, would effectively embrace not only those that constitute a formal organ of the State but also those persons or entities that exercise elements of governmental authority.

Article 4 of the 2001 International Law Commission draft lays down the well-established rule that the conduct of any State organ, being understood as including any person or entity which has that status in accordance with the internal law of the State, shall be considered an act of that State under international law.

The Secretariat would thus favour a definition of an " organ " to read: " [a]ny entity which has that status in accordance with the rules of the organization " .

In addition, the General Secretariat of the Central African Customs and Economic Union, taking advantage of the suggestion that it should have observer status with the United Nations, will immediately take the necessary steps with its highest authorities with a view to making an application for such a status in accordance with the required procedures.

The last term is used in the articles on responsibility of States for internationally wrongful acts and includes, according to article 4, paragraph 2, " any person or entity which has that status in accordance with the internal law of the State " .
