٦ - وفيما يتعلق بالطريقة التي ينبغي اتباعها ﻹكمال إعداد مشروع النظام اﻷساسي، قال المتكلم إن ألمانيا تدعم الاقتراحات المثبتة في الفصل الثاني من تقرير اللجنة، والداعية الى أن يطلب الى الحكومات أن تقدم تعليقات كتابية في موعد غايته ١٥ شباط/فبراير ١٩٩٤، لتمكين اللجنة من الانتهاء من وضع النظام اﻷساسي في دورتها السادسة واﻷربعين المعقودة عام ١٩٩٤.

Mr. SHARIAT BAGHERI (Islamic Republic of Iran) said that, although the matter could be given further thought at a later stage, the criminal responsibility of legal persons should not be included in the Statute at the current juncture because of the difficulties arising over definition, interpretation and enforcement.

Commentary. Based on the assumption that the elements for identically worded crimes under article 8, paragraph 2 (b) and (e), should, mutatis mutandis, also be identical, this proposal is based upon the compromise wording on which delegations agreed for war crimes provisions within article 8, paragraph 2 (b), of the Rome Statute at previous sessions of the Preparatory Commission.
