In cases where they have been deprived of their lands and territories traditionally owned, or such lands and territories have been otherwise used without their free and informed consent, the Committee recommends that the State party take steps to return those lands and territories.
وفي الحالات التي حُرمت فيها من الأراضي والأقاليم التي كانت تملكها تقليدياً، أو تمّ استخدام هذه الأراضي والأقاليم دون موافقتها الحرة والمستنيرة، توصي اللجنة الدولة الطرف باتخاذ خطوات لإعادة تلك الأراضي والأقاليم.

Where indigenous peoples have been deprived of lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, the Committee on the Elimination of Racial Discrimination has found that the State should take steps to return those lands and territories.

5. The Committee especially calls upon States parties to recognize and protect the rights of indigenous peoples to own, develop, control and use their communal lands, territories and resources and, where they have been deprived of their lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, to take steps to return those lands and territories.
5- وتدعو اللجنة الدول الأطراف، بصفة خاصة، إلى أن تقر وتحمي حقوق الشعوب الأصلية في امتلاك وتنمية ومراقبة واستخدام أراضيها وأقاليمها ومواردها المشاعة، وفي حالة ما إذا حرمت، دون موافقة منها عن طيب خاطر وعن بيّنة، من الأراضي والأقاليم التي كانت تملكها تقليديا أو تسكنها أو تستخدمها بأي طريقة أخرى، أن تتخذ خطوات لإعادة تلك الأراضي والأقاليم.

64. In this Recommendation, the Committee also especially called upon States parties to recognize and protect the rights of indigenous peoples to own, develop, control and use their communal lands, territories and resources and, where they have been deprived of their lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, to take steps to return those lands and territories.

In cases where indigenous communities have been deprived of their lands and territories traditionally owned, the Committee recommends that the State party take steps to return those lands and territories or to provide adequate reparation measures, in accordance with paragraph 5 of general recommendation No. 23 (1997) on the rights of indigenous peoples.
وفي حالة حرمان مجتمعات الشعوب الأصلية من أراضيها وأقاليمها التي كانت تمتلكها تقليدياً، توصي اللجنة بأن تتخذ الدولة الطرف خطوات لإعادة هذه الأراضي والأقاليم أو توفير تدابير جبر مناسبة وفقاً للفقرة 5 من التوصية العامة رقم 23(1997) بشأن حقوق الشعوب الأصلية.
