2. Such State shall not authorize vessels flying its flag to engage in fishing operations for the straddling fish stocks or highly migratory fish stocks which are subject to the conservation and management measures established by such organization or arrangement.
٢ - ليس لتلك الدولة أن تأذن للسفن الرافعة لعلمها بالدخول في عمليات لصيد اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال الخاضعة لتدابير الحفظ والادارة التي وضعتها تلك المنظمة أو ذلك الترتيب.

2. A flag State conducting an investigation of an alleged violation of conservation and management measures for straddling fish stocks or highly migratory fish stocks may request the assistance of any other State whose cooperation may be useful in the conduct of that investigation.
٢ - لدولة العلم التي تجري تحقيقا في انتهاك يدعى وقوعه لتدابير حفظ وإدارة اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال أن تطلب المساعدة من أي دولة أخرى قد يكون تعاونها مفيدا في إجراء ذلك التحقيق.

2. Such State shall not authorize vessels flying its flag to engage in fishing operations for the straddling fish stocks or highly migratory fish stocks which are subject to the conservation and management measures established by such organization or arrangement.
٢ - لا تأذن تلك الدولة للسفن الرافعة لعلمها بالدخول في عمليات لصيد اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال الخاضعة لتدابير الحفظ والادارة التي وضعتها تلك المنظمة أو ذلك الترتيب.

(d) " arrangement " means a cooperative mechanism established in accordance with the Convention and this Agreement by two or more States for the purpose, inter alia, of establishing conservation and management measures in a subregion or region for one or more straddling fish stocks or highly migratory fish stocks.
)د( يعني مصطلح " ترتيب " ، آلية تعاونية تقوم بانشائها وفقا للاتفاقية ولهذا الاتفاق دولتان أو أكثر ﻷغراض منها وضع تدابير للحفظ واﻹدارة في منطقة دون إقليمية أو منطقة إقليمية فيما يتعلق برصيد أو أكثر من اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال.

(d) " arrangement " means a cooperative mechanism established in accordance with the Convention and this Agreement by two or more States for the purpose, inter alia, of establishing conservation and management measures in a subregion or region for one or more straddling fish stocks or highly migratory fish stocks.
)د( يعني مصطلح " ترتيب " ، آلية تعاونية تقوم بانشائها وفقا للاتفاقية وهذا الاتفاق دولتان أو أكثر ﻷغراض منها وضع تدابير للحفظ واﻹدارة في منطقة دون إقليمية أو منطقة إقليمية فيما يتعلق برصيد أو أكثر من اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال.

7. If a natural phenomenon has a significant adverse impact on the status of straddling fish stocks or highly migratory fish stocks, States shall adopt conservation and management measures on an emergency basis to ensure that fishing activity does not exacerbate such adverse impact. States shall also adopt such measures on an emergency basis where fishing activity presents a serious threat to the sustainability of such stocks.
٧ - إذا كانت ﻹحدى الظواهر الطبيعية آثار ضارة كبيرة على حالة اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال، تتخذ الدول، على أساس طارئ، تدابير للحفظ واﻹدارة من أجل ضمان ألا يؤدي نشاط الصيد إلى تفاقم تلك اﻵثار الضارة، وتتخذ الدول أيضا تدابير من هذا القبيل على أساس طارئ في الحالات التي يشكل فيها نشاط الصيد تهديدا خطيرا لاستدامة تلك اﻷرصدة.

12. Where no appropriate subregional or regional fisheries management organization or arrangement exists to establish conservation and management measures for particular straddling fish stocks or highly migratory fish stocks, States concerned shall enter into consultations with a view to entering into appropriate arrangements to ensure effective conservation and management of the stocks in question.
٢١ - وحيثما لا يكون هناك منظمة أو ترتيبات مناسبة اقليمية أو دون اقليمية لادارة مصائد اﻷسماك تتولى اتخاذ التدابير المتعلقة بالحفظ والادارة بالنسبة ﻷنواع معينة من اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال، تدخل الدول المعنية في مشاورات بغية التوصل إلى ترتيبات مناسبة لتكفل فعالية الحفظ والادارة لﻷرصدة السمكية ذات الصلة.
