1. The author of the communication is A, a Cambodian citizen who, at the time of submission of his communication on 20 June 1993, was detained at the Department of Immigration Port Hedland Detention Centre, Cooke Point, Western Australia.
١ - صاحب الرسالة هو أ.، وهو مواطن كمبودي، كان محتجزا، في وقت تقديم رسالته في ٢٠ حزيران/يونيه ١٩٩٣، في مركز هيدلاند للاحتجاز التابع ﻹدارة الهجرة في كوك بوينت بغرب استراليا.

Regarding the argument that the submission of his communication amounts to an abuse of the right of submission, the applicant denies the existence of such abuse and recalls that there is no deadline for submitting a communication.
في صدد القول بأن تقديم بلاغه يشكل حالة من سوء استعمال الحق في تقديم البلاغات، ينفي وجود أي سوء استعمال ويشير إلى عدم وجود أي أجل نهائي لتقديم البلاغات.

6.5 The Committee further considers that the author's detention on death row, where, at the time of submission of his communication, he had been waiting for 13 years for the hearing of his appeal, raises issues under article 7 of the Covenant.

According to the information from the Office of the Prosecutor General, during a meeting with a prosecutor, the author explained that, in fact, he had been provided with the requested information concerning the sentences of death penalty in 2006, shortly after the submission of his communication to the Committee.

4. By submission of 10 February 1994, the State party provides information about the domestic remedies available in the Czech Republic and confirms that the author has exhausted the remedies that were available at the time of the submission of his communication to the Committee.
٤ - تقدم الدولة الطرف، في رسالة مؤرخة ٠١ شباط/فبراير ٤٩٩١، معلومات عن سبل الانتصاف المحلية المتاحة في الجمهورية التشيكية وتُقرﱡ بأن صاحب البلاغ قد استنفد سبل الانتصاف التي كانت متاحة وقت تقديم بلاغه إلى اللجنة.

3.9 The author claims a violation of article 14, paragraph 3 (c), in relation to cases Nos. 6823/94 and 6824/94, as he was detained pending trial for over seven years since his initial indictments (eight since his arrest), and had not been tried on the date of submission of his communication.
3-9 ويدعي صاحب البلاغ حدوث انتهاك للفقرة 3(ج) من المادة 14، فيما يتصل بالقضيتين رقـم 6823/94 و6824/94، بالنظر إلى أنه قد احتُجز في انتظار المحاكمة لأكثر من سبع سنوات منذ صدور لوائح الاتهام الأولية ضده (أي لثماني سنوات منذ إلقاء القبض عليه)، وأنه لم يحاكَم حتى تاريخ تقديم بلاغه.

2.10 Since the submission of his communication, however, the situation has improved significantly for the author; he was reinstated in his post on 16 April 1998 in accordance with a Supreme Court order of 30 January 1997 annulling Decree No. 87/747, the Decree removing him from his post.
2-10 بيد أنه منذ تقديم هذا البلاغ تحسنت الحالة بصورة ملحوظة بالنسبة لصاحب البلاغ، وقد أُعيد إلى منصبه في 16 نيسان/أبريل 1998 وفقاً للأمر الصادر عن المحكمة العليا في 30 كانون الثاني/يناير 1997 القاضي بإلغاء المرسوم رقم 87/747 وهو المرسوم الذي قضى بتنحيته عن منصبه.
