ولا ينبغي أن تُشجَّع الجهة المشترية دوما على اختيار العطاء الفائز التالي.

(1) Subject to articles 12 and 34 (7), the tender that has been ascertained to be the successful tender pursuant to article 34 (4) (b) shall be accepted.

(w) Any formalities that will be required, once a successful tender has been accepted, for a procurement contract to enter into force, including, where applicable, the execution of a written procurement contract and approval by another authority pursuant to article 22 of this Law, and the estimated period of time following the dispatch of the notice of acceptance that will be required to obtain the approval;

The cancellation of the procurement may be required for example where collusion between the supplier or contractor presenting the successful tender and the supplier or contractor presenting the next successful tender is suspected since this may lead to the acceptance of the tender with the abnormally high price.
فقد يلزم إلغاء الاشتراء على سبيل المثال عندما يُشتبه في وجود تواطؤ بين المورِّد أو المقاول الذي يقدم العرض الفائز والمورِّد أو المقاول الذي يقدم العرض الفائز التالي نظرا لأنَّ هذا يمكن أن يؤدي إلى قبول العطاء المرتفع السعر ارتفاعا غير عادي.

The final tenders shall be evaluated and compared in order to ascertain the successful tender as defined in article 32 (4) (b).

(6) Subject to articles [12, 12 bis and other appropriate references] of this Law, the procuring entity shall accept the successful tender(s), and shall promptly notify the successful supplier(s) or contractor(s) that it has accepted their tender(s).
(6) رهنا بأحكام المواد [12 و12 مكررا وسائر الإحالات المناسبة] من هذا القانون، تقبل الجهة المشترية العطاء الفائز (العطاءات الفائزة) وتُخطر فورا المورّد أو المقاول الفائز (المورّدين أو المقاولين الفائزين) بأنها قبلت عطاءه (عطاءاتهم).
