1. The present report is the first report to be submitted to the General Assembly since the mandate on summary and arbitrary executions was established by the Economic and Social Council in its resolution 1982/35 of 7 May 1982.
١ - هذا التقرير هو أول تقرير يقدم الى الجمعية العامة منذ أن أنشأ المجلس الاقتصادي والاجتماعي الولاية بشأن حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في قراره ١٩٨٢/٣٥ المؤرخ ٧ أيار/مايو ١٩٨٢.

The Special Rapporteur on extrajudicial, summary and arbitrary executions lists the Convention on the Rights of the Child as among the standards which are taken into account in the exercise of his mandate.

The first communication, dated 17 October 1995 following an urgent appeal transmitted by the Special Rapporteur on extrajudicial, summary and arbitrary executions, raised the concern of the Special Rapporteur over the allegation that Balabagan's original sentence of seven years' imprisonment had been overturned and replaced by the death penalty.
وعبرت المقررة الخاصة في رسالتها اﻷولى المؤرخة في ٧١ تشرين اﻷول/أكتوبر ٥٩٩١، التي أتت في إثر نداء مستعجل من المقرر الخاص المعني بحالات اﻹعدام بلا محاكمة أو بإجراءات موجزة واﻹعدام التعسفي عن قلقها إزاء الادعاءات القائلة بأن الحكم اﻷصلي الصادر بسجن بالاباغان سبع سنوات قد نقض واستبدل باﻹعدام.

89. While the Special Rapporteur has received reports and specific allegations of shelling and bombardments of civilian settlements, the most consistent violation of the right to life is said to stem from the continuing summary and arbitrary executions within the border areas, resulting in the death of large numbers of innocent persons, including women, children and elderly persons.

10. Urges the Special Rapporteur to continue to draw to the attention of the United Nations High Commissioner for Human Rights such situations of extrajudicial, summary and arbitrary executions as are of particularly serious concern to him or where early action might prevent further deterioration;

67. Ms. Jahangir (Special Rapporteur on extrajudicial, summary or arbitrary executions) drew attention to the explanation for the absence of an interim report to the General Assembly on extrajudicial, summary and arbitrary executions which was given in paragraph 4 of document A/53/337.

A wide variety of human rights violations occurred in Myanmar; they included summary and arbitrary executions, torture, arbitrary arrests and detention, violations of the freedom of opinion, association, movement and residence, and forced labour.

Afghanistan has suffered under more than 23 years of conflict and grave violations of human rights, including extrajudicial, summary and arbitrary executions.

In this connection it may be recalled that the Special Rapporteur on extrajudicial, summary and arbitrary executions communicated his concern to the Government regarding 43 persons who were allegedly publicly executed in Lagos on 22 July 1995 following proceedings which fell short of international standards.

313. The Committee deplores the fact that cases of summary and arbitrary executions, torture, death threats, arbitrary and unlawful detention and violence against detainees and other prisoners are seldom properly investigated and very frequently go unpunished.
٣١٣ ـ وأعربت اللجنة عن أسفها ﻷن عمليات اﻹعدام بدون محاكمة وبشكل تعسفي والتعذيب والتهديد بالقتل والحبس التعسفي وغير المشروع وأعمال العنف التي يتعرض لها السجناء قليلا ما يكون موضوع تحقيق مناسب وكثيرا ما تظل دون عقوبة.

69. The Committee is deeply concerned about the cases of summary and arbitrary executions, enforced or involuntary disappearances, torture and arbitrary or unlawful detention committed by members of the army, security or other forces during the period under review that have been brought to its attention.
٦٩ - وتعبر اللجنة عن قلقها البالغ إزاء حالات الاعدام بإجراءات موجزة والاعدام التعسفي وحالات الاختفاء القسري أو غير الطوعي والتعذيب والاحتجاز التعسفي أو غير القانوني، التي ارتكبها أفراد الجيش أو اﻷمن أو قوات أخرى أثناء الفترة المستعرضة والتي أُبلغت اللجنة بها.

28. The Committee deplored the large number of cases of summary and arbitrary executions, enforced or involuntary disappearances, torture and arbitrary or unlawful detention committed by members of the army, security and other forces.
٨٢- وأعربت اللجنة عن أسفها إزاء العدد الضخم من حالات اﻹعدام بلا محاكمة واﻹعدام التعسفي وحالات الاختفاء القسري أو غير الطوعي وحالات التعذيب والاحتجاز التعسفي أو غير القانوني المنسوبة إلى أفراد الجيش أو قوات اﻷمن أو قوات حفظ النظام اﻷخرى.

51. Mr. Ghanei (Islamic Republic of Iran), speaking in explanation of vote after the voting, said that while his country condemned extrajudicial, summary and arbitrary executions and had supported the draft resolution as amended, it had reservations with regard to paragraph 5, which did not reflect the universal responsibility of States to prevent such executions.
